Resolution authorizing City execution of an Intergovernmental Cooperation Agreement between the City of Milwaukee and the Milwaukee Metropolitan Sewerage District for the purposes of delegating responsibilities for the design phase of the North 30th Street Corridor Phase 2 Stormwater West Basin project.
Analysis
This resolution authorizes City execution of an Intergovernmental Cooperation Agreement between the City of Milwaukee and the Milwaukee Metropolitan Sewerage District for the purposes of delegating responsibilities for the design phase of the North 30th Street Corridor Phase 2 Stormwater West Basin project, in the 1st and 7th Aldermanic Districts, in an area around North 35th St between West Capitol Drive and West Congress Avenue and in West Capitol Drive between North 31st Street and North 35th Street.
Body
Whereas, Flooding has been reoccurring in the area around North 30th Street Corridor between West Townsend Street and West Hampton Avenue located within the Lincoln Creek watershed; and
Whereas, The July 2010 rain event caused damages exceeding $32 million and in extreme wet weather events, such flood damages are likely to continue to occur without improvements to the Milwaukee Metropolitan District‘s (District) and City of Milwaukee’s (City) infrastructure serving the North 30th Street Corridor; and
Whereas, The District has been making substantial investments to reduce the risk of flooding along Lincoln Creek north of the North 30th Street Corridor; and
Whereas, As a result of the area’s topography, historical development patterns, and the limited capacity of existing infrastructure, flooding continues to occur in areas within the Lincoln Creek watershed, but outside of the Lincoln Creek floodplain; and
Whereas, When reducing flooding in the areas outside of the Lincoln Creek floodplain, stormwater needs to be managed to prevent increasing flooding along Lincoln Creek; and
Whereas, The District has completed a planning level study that describes stormwater management improvements that could reduce flood damage in the North 30th Street Corridor; and
Whereas, These improvements include detention basins and new or modifications to City-owned storm sewers; and
Whereas, Reduced flood risks and additional green infrastructure are likely to promote redevelopment within the North 30th Street Corridor; and
Whereas, Coordinated flood reduction efforts would provide better results than could be achieved by the District or by the City acting separately, the District and the City are willing to enter into an Intergovernmental Cooperation Agreement (Agreement) describing the individual responsibilities of the District and the City; and
Whereas, The District’s responsibilities and the City’s responsibilities are detailed in the Agreement, a copy of which is attached to this file; and
Whereas, The Agreement applies to the preliminary and final design of the stormwater improvements north of West Capitol Drive west of North 31st Street and east of North 35th Street; and
Whereas, The District and the City are each responsible for funding the respective improvements that each designs, constructs, operates, and maintains under this Agreement; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Intergovernmental Cooperation
Agreement between the City of Milwaukee and Milwaukee Metropolitan Sewerage District delegating responsibilities for the design phase of the North 30th Street Corridor Phase 2 Stormwater West Basin project, is approved as attached to this file, or one in substantially the same form and substance as submitted; and, be it
Further Resolved, That the appropriate City officers and employees, including the Commissioner of Public Works, are hereby authorized to sign the Agreement, or one in substantially the same form and substance as submitted, and to undertake such acts as are required of the City thereunder or in furtherance thereof, to effectuate the Agreement and this resolution, including signing of deeds and easements contemplated and required by the Agreement; and, be it
Further Resolved, That any expenditure of City funds that may be necessary as a result of the City signing the Agreement will be brought forth for Common Council consideration and approval.
