Resolution approving the report for public improvements on which Public Hearing requirements have been waived in the alley between S. Delaware Ave., S. Ellen St., E. Estes St., E. Iron St., S. Kinnickinnic Ave., and S. Linebarger Ter. (southerly half) in the 14th Aldermanic District. (Infrastructure Services Division)

- ANALYSIS -
This resolution confirms the report of the Commissioner of Public Works for improvements on which the benefited property owner has waived their rights to a public hearing. The resolution authorizes the levying of special assessments and directs the installation and construction of said public improvements.
BODY:
Whereas, The limits of the referenced alley have been extended and 7 property owners would be assessed accordingly for work undertaken abutting their property and each has signed a petition and waiver authorizing this work to be done and assessed to them using the normal and customary special assessment policy; and
Whereas, The Common Council of the City of Milwaukee adopted a preliminary resolution determining it necessary and in the public interest to construct and levy special assessments for the following improvements:
Alley between S. Delaware Ave., S. Ellen St., E. Estes St., E. Iron St., S. Kinnickinnic Ave., and S. Linebargar Ter. (Omit northerly 360 ft. m/l) (887-0880-1) File Number 960294: Concrete alley pavement reconstruction, replace some abutting sidewalk and driveway approaches, and grading. (Nonassessable Alley Paving Fund 31-523---212-0001 -- $5,370; Assessable Alley Paving Fund 71-523---212-0001 -- $4,890)
in the 14th Aldermanic District of the City of Milwaukee; and
Whereas, The report of the Commissioner of Public Works has been filed with the City Clerk; and
Whereas, Waivers of notice and hearing of all abutting property owners have been filed; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the report of the Commissioner of Public Works be approved; and, be it
Further Resolved, That said Commissioner of Public Works is authorized and directed to proceed with said work in accordance with said report pursuant to Section 66.60 and any other pertinent sections of the Wisconsin Statutes and in the manner directed by Section 115-42 of the Milwaukee Code of Ordinances; and, be it
Further Resolved, That the proper City departments take such action as is required of them to assess the abutting properties and collect such assessment in the manner directed by said Section 115-42; and, be it
Further Resolved, That the City Comptroller is authorized and directed to transfer such funds which are available for this purpose to the appropriate capital purpose subaccount; and, be it
Further Resolved, That project Alley S. Delaware Ave. (887-0880-1) will be billed after January 1, 1999, but not before 12 months after the project contract has been completed.
