Analysis
This resolution permits the Brady Area Foundation for Arts and Education permission to install and maintain a video projector and computer with associated communication and electrical wiring onto and under the Holton Street Bridge near North Water Street subject to review and approval of the Commissioner of Public Works.
Body
Whereas, The Brady Area Foundation for Arts and Education is a non-profit foundation working to promote artistic, cultural and educational endeavors in the Brady Street area; and
Whereas, The Brady Area Foundation for Arts and Education desires to install a video projector and computer onto and under the Holton Street Bridge near North Water Street as part of the River Pulse public art and educational project; and
Whereas, Said computer will be connected to a data sonde located in the Milwaukee River, which will measure five variables of water quality; and
Whereas, The computer will translate said measurements into dynamic flowing video art and will be projected against a wall under the Holton Street Bridge via the video projector; and
Whereas, Brady Area Foundation for Arts and Education is willing to maintain the video projector and computer with associated communications and electrical wiring installed in the public right-of-way; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that Brady Area Foundation for Arts and Education is granted permission to install and maintain a video projector; a computer; and the required associated electrical and communications wiring onto and under the Holton Street Bridge near North Water Street in the public right-of-way; and, be it
Further Resolved, That location and method of installation of said items shall be subject to the approval of the Commissioner of Public Works; and, be it
Further Resolved, That Brady Area Foundation for Arts and Education shall obtain all necessary permits for the installation of said items in the public right-of-way; and, be it
Further Resolved, That Brady Area Foundation for Arts and Education shall keep and maintain the video projector and associated communication and electrical wiring to the satisfaction of the Commissioner of Public Works; and, be it
Further Resolved, That whenever permission for said items is discontinued for any reason whatsoever, including public necessity whenever so ordered by resolution adopted by the Common Council, Brady Area Foundation for Arts and Education shall not only remove all benches, but shall also restore to its former condition and to the approval of the Commissioner of Public Works the curb, pavement or other public improvement which was removed, changed or disturbed by reason of the granting permission for said signs. Such grantee shall be entitled to no damages due to the alteration and/or removal for such purposes.
