Title
Resolution accepting a Park Easement Agreement from River's Crest LLC in the 6th Aldermanic District. (DCD)
Analysis
This resolution accepts a public access and park easement on bluff land in the vicinity of North Commerce Street, North Dousman Street and North Riverboat Road. Adoption of this resolution approves the Park Easement Agreement and authorizes the proper City officials to enter into said Agreement.
Body
Whereas, Under File No. 020633 and 020632, the Common Council of the City of Milwaukee ("Common Council") approved General Planned Development and Detailed Planned Development zoning districts for the RiverCrest Condominiums project; and
Whereas, Under File No. 030744, the Common Council approved Certified Survey Map No. 7369 for the RiverCrest Condominiums project; and
Whereas, The General Planned Development zoning district and the Detailed Planned Development zoning district contemplated the establishment of a pedestrian access easement to be granted to the City of Milwaukee ("City"); and
Whereas, Certified Survey Map No. 7369 for the RiverCrest Condominiums project established Lot 1 of said Map as the pedestrian access easement to the City; and
Whereas, A Park Easement Agreement ("Agreement"), a copy of which is attached to this Common Council File, was prepared to perfect the public pedestrian access responsibilities of the Grantor (River's Crest LLC) and the Grantee (City of Milwaukee); and
Whereas, The Common Council desires to enter into said Agreement to provide public access and open green space in connection with the RiverCrest Condominiums project; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that said Park Easement Agreement is approved; and, be it
Further Resolved, That the proper City officials are authorized and directed to enter into said Agreement consistent with the intent and purpose of this resolution.
