Whereas, The Outside Counsel/Expert Witness Fund Special Purpose Account is to be used by the City Attorney's Office for the purpose of retaining experts and outside legal counsel; and
Whereas, A series of claims have been filed alleging reverse racial discrimination based upon adverse impact in selection procedures for promotions to Captain in the Milwaukee Police Department; and
Whereas, It would be in the City's best interest to retain an expert to assist in evaluating the issues raised at this stage of litigation; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the expenditure of $10,000 is authorized from the Outside Counsel/Expert Witness Fund Number 0001 9990 S157 006300 to the City Attorney's Office for the purpose of paying expert witnesses and other litigation costs related to evaluating the claims of reverse racial discrimination based upon adverse impact in promotions to Captain in the Milwaukee Police Department, and, be it
Further Resolved, That the City Attorney is authorized to pay litigation expenses and expenses of the expert witnesses after review and approval of invoices; and, be it
Further Resolved, That the City Comptroller is authorized and directed to make whatever fund transfers are necessary or appropriate to carry out the provisions of this resolution; and, be it
Further Resolved, That the application of these appropriated funds to a case other than the one referred to herein shall be subject to the further direction and approval of the Common Council.
