Analysis
This resolution confirms the report of the Commissioner of Public Works, as modified by the Common Council Committee, on projects for which Public Hearings have been held. The resolution authorizes the levying of special assessments and directs the installation and construction of said public improvements.

Whereas, The Common Council of the City of Milwaukee adopted preliminary resolutions, determining it necessary and in the public interest to construct and levy special assessments for the following improvements:
1st Aldermanic District
W. Eggert Pl. - N. 46th St. to N. 50th St. (ST211060130) File Number 050805: Asphalt pavement resurfacing, replace curb and gutter, sidewalk and driveway approaches where necessary, sodding, and grading. (Assessable Reconstruction Paving Fund -- $31,200; Nonassessable Reconstruction Paving Fund -- $88,800). The total cost to date for this project is $140,000.
2nd Aldermanic District
N. 64th St. - W. Hampton Ave. to W. Villard Ave. (ST211060136) File Number 050805: Asphalt pavement resurfacing, replace curb and gutter, sidewalk and driveway approaches where needed, sodding, grading, and tree removal where necessary. (Assessable Reconstruction Paving Fund -- $103,100; Nonassessable Reconstruction Paving Fund -- $147,500). The total cost to date for this project is $279,000.

W. Walnut St. (North Roadway) - N. 6th St. to N. 10th St. (ST211050108) File Number 030748: Concrete pavement reconstruction, replace all curb and gutter, replace sidewalk and driveway approaches where necessary, sodding, and grading. (Assessable Reconstruction Paving Fund -- $11,500; Nonassessable Reconstruction Paving Fund -- $356,800). The total cost to date for this project is $404,000.

Norwich St. (ST211050139) File Number 050933: Asphalt pavement resurfacing, replace curb and gutter, sidewalk and driveway approaches where necessary, sodding, and grading. (Assessable Reconstruction Paving Fund -- $21,600; Nonassessable Reconstruction Paving Fund -- $14,900). The total cost to date for this project is $47,000.

Norwich St. (ST211050136) File Number 050565: Asphalt pavement resurfacing, replace curb and gutter, sidewalk and driveway approaches where necessary, sodding, and grading. (Assessable Reconstruction Paving Fund -- $22,300; Nonassessable Reconstruction Paving Fund -- $16,300). The total cost to date for this project is $46,000.

Norwich St. - S. 51st St. to S. 55th St. (ST211050137) File Number 050565: Asphalt pavement resurfacing, replace curb and gutter, sidewalk and driveway approaches where necessary, sodding, and grading. (Assessable Reconstruction Paving Fund -- $32,000; Nonassessable Reconstruction Paving Fund -- $106,200). The total cost to date for this project is $157,000.

Tesch Ave. - S. 52nd St. to S. 54th St. (ST211050138) File Number 050224: Asphalt pavement resurfacing, replace curb and gutter, sidewalk and driveway approaches where necessary, sodding, and grading. (Assessable Reconstruction Paving Fund -- $20,400; Nonassessable Reconstruction Paving Fund -- $54,200). The total cost to date for this project is $85,000.

Burnham St. - S. 5th St. to S. 6th St. (ST211060126) File Number 040689: Asphalt pavement resurfacing, replace all curb and gutter, replace sidewalk and driveway approaches where necessary, sodding, and grading. (Assessable Reconstruction Paving Fund -- $9,600; Nonassessable Reconstruction Paving Fund -- $47,500). The total cost to date for this project is $61,000.

S. Clement Ave. - S. Whitnall Ave. to E. Howard Ave. (Portions in the City of St. Francis) (ST320042401/WK6831060007) (2661-01-70) File Number 040400: Asphalt pavement resurfacing, replace curb and gutter, sidewalk and driveway approaches where necessary, sodding, and grading. (City Share Assessable Paving Fund -- $24,000; City Share Nonassessable Paving Fund -- $36,000; Grantor Paving Fund -- $163,000; Grantor Paving Reimbursable Cash Fund -- $54,000; Nonassessable Sewer Funds -- $3,000; City of St. Francis Paving -- $260,000). The total cost to date for this project is $686,000. These funds are to be transferred to the construction account ST320042410.

Whereas, The report of the Commissioner of Public Works has been filed with the City Clerk; and
Whereas, Notices have been sent to all interested persons and public hearings held; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works’ Report, as amended at said Public Hearing, is approved and the properties therein identified are benefited; and, be it
Further Resolved, That said Commissioner of Public Works is authorized and directed to proceed with said work in accordance with said report pursuant to Section 66.0703 and any other pertinent sections of the Wisconsin Statutes and in the manner directed by Section 115-42 of the Milwaukee Code of Ordinances; and, be it
Further Resolved, That the proper departments take such action as is required of them to assess the abutting or adjacent properties and collect such assessment in the manner directed by Section 115-42 of the Milwaukee Code of Ordinances; and, be it
Further Resolved, That the Department of Public Works is authorized to use the funding as specified in the above description of work; and, be it
Further Resolved, That the City Comptroller is authorized and directed to transfer such funds which are available for this purpose to the appropriate capital Project/Grant accounts; and, be it
Further Resolved, That the projects do not involve any parcels of agricultural land which are eligible for deferred special assessments under the provisions of Section 14.30 of the Milwaukee City Charter; and, be it
Further Resolved, That the City Engineer and the Commissioner of Public Works are hereby authorized to negotiate and enter into an agreement with the State of Wisconsin, Department of Transportation for the City to undertake construction management duties on the following project: S. Clement Ave. (ST320042401/WK6831060007) (2661-01-70); and, be it
Further Resolved, That the City Engineer is authorized and directed to approve and make periodic payments to the State of Wisconsin, Department of Transportation after receipt of invoices from said State for the city’s share of the costs for said project: S. Clement Ave. (ST320042401/WK6831060007) (2661-01-70); and, be it
Further Resolved, That upon the completion of project: S. Clement Ave. (ST320042401/WK6831060007) (2661-01-70) and a determination of the actual costs, it is understood that if the City of Milwaukee’s share is less than the amount previously paid, the difference will be refunded to said City; and, be it
Further Resolved, That projects: W. Eggert Pl. (ST211060130), N. 64th St. (ST211060136), W. Walnut St. (ST211050108), S. 52nd St. (ST211050139), S. 54th St. (ST211050136), W. Norwich St. (ST211050137), W. Tesch Ave. (ST211050138), W. Burnham St. (ST211060126), and S. Clement Ave. (ST320042401/WK6831060007) (2661-01-70) will be billed after January 1, 2008, but not before 12 months after the project contract has been completed; and, be it
Further Resolved, That the following project be deleted from the 2006 Paving Program:
