This resolution authorizes acceptance of Sewer, Water, Communication & Underground Conduit, and Street Lighting Easements in vacated North 28th Street between West Wisconsin Avenue and West Wells Street, in the 4th Aldermanic District.
Body
Whereas, The City of Milwaukee (“City”) requested easements needed for sewer, water, communication & underground conduit, and street lighting facilities located within former public right-of-way of vacated North 28th Street; and
Whereas, said easement areas are in lands owned by Weigand Investments 2711 LLC, Ambassador Suites LLC, and St. Paul’s Evangelical Lutheran Congregation; and
Whereas, The land-owners are willing to grant said easements to the City giving the City permission to enter the properties to construct, operate, maintain, inspect, repair, enlarge, reconstruct, replace, and relocate, as the City deems necessary, the sewer, water, communication & underground conduit, street lighting and related facilities within the easement areas on terms and conditions negotiated by the City’s Department of Public Works, as reflected in the easement documents that have been made part of this file; now, therefore, be it
Resolved, by the Common Council of the City of Milwaukee, that the proper City officials, including the DPW Commissioner, are hereby authorized: (i) to sign Sewer, Water, Communication & Underground Conduit, and Street Lighting Easements in the form and substance submitted to this file (or in substantially the same form and substance as submitted, and to effectuate the intent of this resolution); and (ii) to cause the same to be recorded in the Milwaukee County Register of Deeds Office.
