Resolution approving Amendment No. 1 to the approved Out-of-Program Agreement between Milwaukee Metro Center Development, Inc. (August Urbanek), Auto Nation USA, and the City of Milwaukee for construction of public improvements to support Phase I of the Metro Center Development located generally south of West Good Hope Road and east of US Highway 41. - ANALYSIS - This resolution approves the first amendment to the Out-of-Program Agreement for Phase I of the Metro Center development project. The amendment authorizes repayment by the City to the developers for the cost of road related improvements that are located off of the development site and which would have community-wide benefits.
BODY:
Whereas, On July 11, 1997, the Common Council of the City of Milwaukee adopted file number 970478 being a resolution approving an Out-of-Program Agreement for Phase I of the Metro Center development to be located generally south of West Good Hope Road and east of US Highway 41; and
Whereas, Under the terms of this Out-of-Program Agreement the developers are obligated to fund 100% of certain off-site street improvements including modifications to intersections along North 107th Street at both West Good Hope Road and West Fond du Lac Avenue.
Whereas, As design of these off-site street improvements has progressed it has been determined that they will in fact provide community-wide benefits by serving development throughout the northwest side of the city including projects such as the M&I Data Center and continuing development of the Park Place complex; and
Whereas, Traffic studies performed by the State of Wisconsin and in conjunction with various northwest side developments have indicated that improvements to the North 107th Street intersections with West Good Hope Road and West Fond du Lac Avenue would eventually be needed even without the Metro Center project; and
Whereas, There are currently no funds available in DPW capital accounts to undertake these intersection improvements (estimated to cost approximately $400,000); and
Whereas, Amendment Number 1 to the Metro Center Out-of-Program Agreement provides that the developers will deposit funds for the intersection improvements and that the City will refund the cost of those improvements to the developers in the year following completion of all improvements covered by the Out-of-Program Agreement (expected to be 1999); now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that Amendment Number 1 to the Metro Center Out-of-Program Agreement as attached hereto is hereby approved and that the appropriate City Officials are authorized and directed to execute the amendment.
