Analysis
This ordinance revises various provisions of the code for purposes of correcting errors, clarifying language, eliminating obsolete provisions and updating references.
Body
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
Part 1. Section 79-1-2 of the code is amended to read:
79-1. Definitions.
2. COMMISSIONER shall mean the commissioner of public works and such supervisory employees of the department to whom his >>or her<< authority may be delegated.
Part 2. Section 79-10-2 of the code is amended to read:
79-10. Littering on Street by Motor Vehicle.
2. CONTRACTOR RESPONSIBLE. No person shall allow any vehicle to proceed from any construction site, whether operated by the contractor, his >>or her<< agent, employee or subcontractor, in such manner as to dump, drop, scatter, track or deposit any litter upon any street, alley or public place. The commissioner shall be and is empowered to order any contractor to take such precautions as he deems necessary to prevent littering, and to remove any such litter. In the event any contractor shall fail to comply with an order of the commissioner, said commissioner or any commanding officer of a police district may order such operations stopped.
Part 3. Section 100-54-10-a of the code is amended to read:
100-54. Public Passenger Vehicle Driver's License.
10. CHANGE OF LICENSE CLASSIFICATION.
a. During the license period. Any holder of a license issued under this section is permitted to change the license classification during the license period. Requests for changes of classification shall be made by filing an amendment with the city clerk, and by providing documentation of meeting the qualifications for the license classification under s. 100-54-2 and payment of the fee as provided in [[s. 81-44.7-7]] >>s. 81-44.7-5<<.
Part 4. Section 106-53-2 of the code is amended to read:
106-53. Loitering of Sex Offenders.
2. EXCEPTIONS. This section shall not apply where the actor was >>accompanied<< by his or her parent, guardian or other adult person having his or her care, custody or control, or where that actor was exercising First Amendment rights protected by the U.[[-]]S. constitution or Wisconsin constitution, including freedom of speech, the free exercise of religion, or the right of assembly.
Part 5. Section 225-17-1 of the code is amended to read:
225-17. Independent Plumbing and Drainage System.
1. NEW INSTALLATIONS. The plumbing and drainage system of each new building or structure or a new plumbing and drainage system installed in an existing building or structure shall be entirely separate and independent from that of any other building or structure. Every building or structure shall have an independent connection with a public or private main sewer when available. Private main sewers shall conform to specifications of public main sewers and shall be approved by the department of [[city development]] >>neighborhood services<< and the infrastructure services division, department of public works.
Part 6. Section 225-31-3 and 4 of the code is repealed.
Part 7. Section 355-7-1-c of the code is amended to read:
355-7. Participation of City Residents.
1. REQUIREMENTS.
c. Require that contractors and subcontractors maintain personnel records [[listing the name, address, race and gender of all employees utilized]] for each construction contract, and any records demonstrating that the employees utilized by the contractors and subcontractors in meeting the requirements of this section are residents of the city. These records shall be maintained for 7 years after the contractor or subcontractor has received final payment under its construction contract, and shall be made available to the [[office of equity and inclusion]] >>department of compliance and engagement<< for inspection upon reasonable notice.
Part 8. Section 355-13-4-c of the code is amended to read:
355-13. Other Requirements.
4. SMALL BUSINESS ENTERPRISES.
c. A business that is certified with Milwaukee County, the state of Wisconsin or the U.S. federal government as a disadvantaged, emerging or small business enterprise, or some other program that in the discretion of the [[chief equity officer]] >>director<< of the [[office of equity and inclusion]] >>department of compliance and engagement<< is comparable to the city’s small business enterprise program, shall qualify as a small business enterprise for the purposes of this chapter, and shall be included when determining compliance with the subsection.
