Title

Resolution relating to acceptance and execution of a Green Infrastructure funding from the Milwaukee Metropolitan Sewerage District for the construction of five bioswales and three grass swales at West Becher Street near the Interstate 43 overpass and authorizing entry into post construction maintenance covenant, in the 12th Aldermanic District.

Analysis

This resolution authorizes the Department of Public Works, Infrastructure Services Division, to apply for and accept Milwaukee Metropolitan Sewerage District Green Infrastructure funding in the amount of $235,000 for the installation of five bioswales and three grass swales at West Becher Street near the Interstate 43 overpass. The resolution also authorizes the Commissioner of Public Works to execute a post installation Maintenance Covenant with the Milwaukee Metropolitan Sewerage District.

Body

Whereas, The Milwaukee Metropolitan Sewerage District (MMSD) is responsible for collecting and treating wastewater from local sewerage systems; and

 

Whereas, Green infrastructure, such as bioswales and grass swales, reduces the volume of stormwater in the sewer system and the amount of pollutants discharged to surface waters; and

 

Whereas, During wet weather, stormwater enters the sewerage system and surface water, increasing the volume of wastewater the District must collect and treat and increasing pollution levels in those waterways and increasing the risk of flooding; and

 

Whereas, MMSD wishes to expedite the amount of GI installed in its service area and this agreement includes plans to install GI that supports the District’s GI goals; and

 

Whereas, The cost of the bioswales and grass swales portion of the reconstruction projects is approximately $235,000; and

 

Whereas, The City will enter into a post installation Maintenance Covenant with MMSD after the completion of the projects; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Department of Public Works, Infrastructure Services Division is hereby authorized to apply, accept, and execute grant funding for the projects from the Milwaukee Metropolitan Sewerage District under the terms specified above; and be it

 

Further Resolved, That the Commissioner of Public Works is authorized and directed to enter into an agreement and/or other documents deemed necessary and agreed to by the Director of Public Works in order to implement the projects and accept MMSD Green Infrastructure funding without further Common Council approval, unless the terms of the grant change as indicated in Common Council File 030712; and, be it

 

Further Resolved, That the Green Infrastructure funding agreement (G98005P184) and the template maintenance covenant submitted to this file are hereby approved, and City personnel, including the DPW Commissioner, are authorized: (i) to cause the City to enter those documents in the same form, or in substantially the same form and substance, as have been submitted to this file; and (ii) to take such further acts as may be contemplated or required to be taken by the City thereunder so as to carry out the intent and purpose of this resolution and those documents; and, be it

 

Further Resolved, That upon approval of this Agreement, the City Comptroller is authorized to create within the Capital Grant and Aid Projects Fund the appropriate Project/Grant Chartfield Value for these projects, and transfer to these accounts the amount required under the agreement and City accounting policy, but not to exceed a ten percent increase of the total amounts reserved for the grantor’s share and local share or $5,000, whichever is greater, as follows:

; and, be it

 

Further Resolved, That these funds are appropriated to the Department of Public Works, which is authorized to expend from the amount budgeted for specific purposes as indicated in the grant budgets and incur costs consistent with the award date; and, be it

 

Further Resolved, That the Commissioner of Public Works shall have the authority to authorize transfers within the project budget so long as the amount expended for any purpose shall not exceed the amount authorized by the budget by 10% and such transfers are in accordance with grantor regulations; and, be it

 

Further Resolved, That the Commissioner of Public Works, on behalf of the City of Milwaukee, is authorized to enter into subcontracts (and leases) as detailed in the project budget and in accordance with City purchasing procedures and grant and aid guidelines for awarding such contracts.
