Title

Substitute ordinance approving the First Amendment to the General Planned Development and amending Phase 2 of the Detailed Planned Development for a planned development known as Kilbourn Square, on land located on the North Side of West Kilbourn Avenue and East of North 24th Street, in the 4th Aldermanic District.

Analysis

This substitute ordinance will allow for the further redevelopment of the former Sinai Samaritan medical complex for Milwaukee City of Hope.

Body

The Mayor and Common Council of the City of Milwaukee (“Common Council”) do ordain as follows:

 

Part 1. There is added to the Milwaukee Code of Ordinances (“Code”) a new section to read as follows:

 

Section 295-810(2)(a).0068.

 

(1) In accordance with the provisions of Section 295-810(1) of the Code relating to the establishment of planned development districts, the Common Council approves the subject amended General Planned Development, a copy of which is attached to this Common Council File as Exhibit A which is on file in the office of the City Clerk and made a part as though fully set forth herein.

 

(2) The zoning map re-affirms the zoning for the area bounded by the centerline of West State Street, a line 128 feet East and parallel to the east line of North 23rd Street, a line 120 feet North and parallel to the north line of West State Street, the centerline of North 22nd Street, the centerline of West State Street, the centerline of North 20th Street, the centerline of West Kilbourn Avenue, the centerline of North 22nd Street, a line 90 feet South and parallel to the south line of West Kilbourn Avenue, the centerline of North 23rd Street, the centerline of West Kilbourn Avenue, and the centerline of North 24th Street.

(1) In accordance with the provisions of Section 295-810(1) of the Code relating to the establishment of planned development districts, the Common Council approves the subject amended Detailed Planned Development, a copy of which is attached to this Common Council File as Exhibit B which is on file in the office of the City Clerk and made a part as though fully set forth herein.

 

(2) The zoning map is amended for all of Parcel 1 and Part of Parcel 2 of Certified Survey Map No. 6876 in the Northeast 1/4 and Southeast 1/4 of the Northwest 1/4 of Section 30, Town 7 North, Range 22 East, in the City of Milwaukee, Milwaukee County, Wisconsin, bounded and described as follows:

 

Commencing at the intersection of West Kilbourn Avenue and North 23rd Street; thence North 00 deg. 10 min. 23 sec. West along the centerline of North 23rd Street 288.25 feet to a point; thence North 89 deg. 49 min. 37 sec. East 136.98 feet to a point; thence North 00 deg. 11 min. 58 sec. West 147.58 feet to a point; thence North 89 deg. 49 min. 37 sec. East 112.42 feet to a point; thence South 00 deg. 18 min. 38 sec. East 89.74 feet to a point; thence South 89 deg. 29 min. 24 sec. East 187.15 feet to a point; thence South 00 deg. 12 min. 47 sec. East 87.18 feet to a point; thence South 88 deg. 18 min. 16 sec. West 12.60 feet to a point; thence North 00 deg. 11 min. 42 sec. West 1.00 feet to a point; thence South 89 deg. 48 min. 18 sec. West 0.80 feet to a point; thence North 02 deg. 21 min. 31 sec. West 3.64 feet to a point; thence South 89 deg. 33 min. 42 sec. The centerline of West State Street, the centerline of North 22nd Street, a line 120 feet North and parallel to the north line of West State Street and a line 128 feet East and parallel to the east line of North 23rd Street; and

 

The centerline of North 23rd Street, the centerline of West Kilbourn Avenue, a line 295.11 feet North and parallel to the north line of West Kilbourn Avenue and a line 167.55 feet West and parallel to the west line of North 23rd Street.

 

(3) The requirements set forth in said general and detailed plans attached to this Common Council File as Exhibits A and B constitute the zoning regulations for the area contained in such planned development district described, provided further, that the effect of the approval of such general and detailed plans is that such plans shall limit and control construction, location, use and operation of all land and structures included within said general and detailed plans to all conditions and limitations set forth in said general and detailed plans.

 

Part 2. Any persons, firm, company or corporation owning, controlling, or managing any building or premises wherein or whereon there shall be placed or there exists anything in violation of the terms of this ordinance; or who shall build contrary to the plans or specifications submitted to and approved by the Commissioner of the Department of City Development, or any person, firm, company or corporation who shall omit, neglect or refuse to do any act required in this ordinance shall be subject to the penalties provided in Section 200-19 of the Code.

 

Part 3. In accordance with the provisions of Section 295-815 of the Code, the City Clerk shall transmit a certified copy of the action taken by the Common Council to the Department of City Development.

 

Part 4. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions. The Common Council declares that it would have passed this ordinance and each section, subsection, sentence, clause, phrase or portion irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases or other portions be declared void or invalid.
