Title

Substitute resolution approving construction of a nonassessable public improvement project at East North Avenue between North Booth Street and North Bremen Street in the Sixth Aldermanic District.

Analysis

This resolution directs the reconstruction of East North Avenue between North Booth Street and North Bremen Street which has been determined to be nonassessable by the Commissioner of Public Works.

Body

Whereas, The Common Council of the City of Milwaukee adopted a preliminary resolution, determining it necessary and in the public interest to reconstruct East North Avenue from North Booth Street to North Bremen Street; and

 

Whereas, East North Avenue from a point east of North Booth Street to North Bremen Street is scheduled for improvement in the spring of 2006.  The project is being funded under the Hazard Elimination Safety (HES) Program; and

 

Whereas, The project was included in the HES program due to a high vehicle crash rate due to substandard alignment; and

 

Whereas, Plans, specifications and cost estimates have been prepared for the project:

E. North Ave. - N. Bremen St. to N. Booth St. (ST320042901) (2445-05-71) File Number 040032:  Concrete pavement reconstruction, replace all curb and gutter, sidewalk and driveway approaches, sodding, and grading, including various geometric changes.  This includes the termination of E. Garfield Ave. pavement at the Kilbourn Park west border and elimination of the E. Garfield Ave. intersection at E. North Ave. (City Share Non-assessable Paving Fund -- $66,000; Grantor Paving Fund -- $460,000; Grantor Paving Reimbursable Cash Fund -- $70,000) These funds are to be transferred to the construction account ST320042910. )  File Number 040032 authorized $29,100,  File Number 050564 authorized $65,000 and File Number 050966 authorized $20,000.  The total cost of the project estimated to be $710,100.

 

; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is authorized and directed to proceed with said work; and, be it

 

Further Resolved, That the City Comptroller is authorized and directed to transfer such funds which are available for this purpose to the appropriate capital Project/Grant accounts; and, be it

 

Further Resolved, That the City Engineer and the Commissioner of Public Works are hereby authorized to negotiate and enter into an agreement with the State of Wisconsin, Department of Transportation for the City to undertake construction management duties on the following project: E. North Ave. (ST320042901) (2445-05-71); and, be it

 

Further Resolved, That the City Engineer is authorized and directed to approve and make periodic payments to the State of Wisconsin, Department of Transportation after receipt of invoices from said State for the city’s share of the costs for said project: E. North Ave. (ST320042901) (2445-05-71); and, be it

 

Further Resolved, That upon the completion of project: E. North Ave. (ST320042901) (2445-05-71) and a determination of the actual costs, it is understood that if the City of Milwaukee’s share is less than the amount previously paid, the difference will be refunded to said City; and, be it

 

Further Resolved, That project E. North Ave. (ST320042901) (2445-05-71) be allocated in the 2006 budget; and, be it

 

Further Resolved, That if surplus 2005 funds become available some or all of the 2006 budget projects may be funded with 2005 funds; and, be it

 

Further Resolved, That the 2006 funded projects are approved pending the approval of the 2006 capital budget; and, be it

 

Further Resolved, That the City Comptroller is authorized and directed to transfer such funds which are available for this purpose to the appropriate capital Project/Grant accounts.
