Title

A substitute ordinance relating to the elimination of obsolete provisions of the building code.

Analysis

This ordinance requires that all building construction plans submitted to the department of city development prior to July 1, 2002, and work performed pursuant to those plans, comply with all applicable provisions of chs. 251 through 266 of the Code of Ordinances, as well as the reference to ch. ILHR 73 (Comm 73) in s. 222-01, as those provisions existed on the date of plan submission.  Plans submitted on or after July 1, 2002, and the work performed pursuant to those plans, shall comply with all applicable provisions of chs. Comm 61 through 65 of the Wisconsin Administrative Code.  This change is necessitated by the restructuring of the State of Wisconsin building code that takes effect July 1, 2002.

Body

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part 1.  Whenever any permit is required by the building code for the erection, construction, enlargement, alteration, repair, moving, improvement, conversion to new use, razing or demolition of any building or structure, or installation of any equipment, occupancy or use therein, and the plans for such work are submitted to the department of city development before July 1, 2002, the plans and work performed pursuant to those plans shall conform with all applicable provisions of chapters 251 through 266 of the Code of Ordinances, as well as the reference to ch. ILHR 73 (Comm 73) in s. 222-01, as those provisions existed on the date of plan submission.

 

Part 2.  Whenever any permit is required by the building code for the erection, construction, enlargement, alteration, repair, moving, improvement, conversion to new use, razing or demolition of any building or structure, or installation of any equipment, occupancy or use therein, and the plans for such work are submitted to the department of city development after June 30, 2002, the plans and work performed pursuant to those plans shall conform with all applicable provisions of chapters Comm 61 through 65 of the Wisconsin Administrative Code.
