Resolution declaring surplus the improved, tax-deed property at 1322 West Groeling Avenue and authorizing acceptance of an unsolicited Offer to Purchase from Mr. Jerry Gainer, in the 6th Aldermanic District. (DCD)
Analysis
This resolution declares said property surplus to municipal needs and authorizes acceptance of an unsolicited Offer to Purchase according to Section 304-49-17, Milwaukee Code of Ordinances.
Body
Whereas, The Department of City Development ("DCD") recommended that the improved, tax-deed property at 1322 West Groeling Avenue be demolished, but subsequently received an unsolicited Offer to Purchase in the amount of $3,350 from Jerry Gainer to rehabilitate said property for investment purposes; and
 
Whereas, Section 304-49-17, Milwaukee Code of Ordinances, allows the City of Milwaukee ("City") to accept unsolicited Offers and convey property to a designated entity for adequate fair market consideration; and
 
Whereas, Said property requires significant rehabilitation, but Mr. Gainer has submitted an acceptable scope of work and evidence of adequate resources to complete the proposed rehabilitation; and
 
Whereas, DCD has reviewed the submitted documents, has reviewed the offering price and believes the price represents fair market value of the property in its "as is, where is" condition and recommends acceptance of said Offer; and
 
Whereas, The City Plan Commission has determined that the property is surplus to municipal needs; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the property at 1322 West Groeling Avenue, Tax Key No. 311-1007-000-7, is declared surplus to municipal needs and that the Commissioner of DCD or designee is authorized to accept said unsolicited Offer to Purchase from Jerry Gainer in the amount of $3,350; and, be it
 
Further Resolved, That the proper City officials are authorized and directed to perform such acts as may be required to consummate the sale of said property and that the proceeds, less sale expenses and a 20 percent disposition cost reimbursement to the Redevelopment Authority of the City of Milwaukee, be credited to the Reserve For Tax Deficit Fund Account No. 0001-334106; and, be it
 
Further Resolved, That as a condition of the sale of surplus property, purchaser is required to bring property into compliance with applicable building codes within the time specified by the Department of Neighborhood Services or property may revert to the ownership of the City of Milwaukee upon action by the Common Council.
