Analysis
This ordinance classifies personal service establishments (e.g., barber and beauty shops, music studios and tanning salons) as special uses whenever they operate between the hours of 12 a.m. and 5 a.m. and are located within 100 feet of a residential zoning district or a residential planned development. This restriction does not apply to personal service establishments located in central business zoning districts.
This ordinance also modifies the definition of "personal services" to include tattooing and body-piercing establishments. This change is consistent with the existing City-staff practice of classifying tattooing and body-piercing businesses as personal service establishments.
