Analysis
This ordinance adds 2 new parties to the list of those who must receive hearing notices when property owners in historic preservation districts request certificates of appropriateness. These parties are:
1. The common council member representing the district in which the property is located.
2. All persons or corporations who own property that is both within 200 feet of the property that is the subject of the hearing and within the same historic district.

The Mayor and Common Council of the City of Milwaukee do ordain as follows:
Part 1. Section 308-81-9-c of the code is repealed and recreated to read:
308-81. Historic Preservation Commission.
9. REGULATION OF CONSTRUCTION, RECONSTRUCTION, REHABILITATION AND DEMOLITION.
c. Notification. Notice of hearing shall be provided to the following parties:
c-1. The applicant at his or her residence or place of business, or, if the applicant is a corporation, at the address stated in the application. This notice shall be by certified letter. This letter may contain a requirement for supplemental information, including, but not limited to, any photographs, plans, floor plans, elevations and detail drawings of any structure or portion thereof to be subject to change. If the applicant is unable to furnish any or all required supplemental information by the date set for a hearing on the application, the applicant may request such a delay as may be deemed reasonable by the commission for obtaining the required information. The commission may also grant a request for a delay for any other good cause.
c-2. The council member representing the district in which the property is located.
c-3. All persons or corporations who own property that is both within 200 feet of the property that is the subject of the hearing and within the same historic district. This notice shall be by first class mail.
