Substitute resolution approving the levying of assessments and construction of assessable public improvement projects at various locations.

BODY:

Whereas, The Common Council of the City of Milwaukee adopted preliminary resolutions, determining it necessary and in the public interest to construct and levy special assessments for the the following improvements:

 

4th Aldermanic District

 

Alley between W. Highland Blvd., W. State St., N. 29th St. and N. 33rd St. (E-W Leg) (886-0625-7) File Number 85-1511: Concrete alley pavement reconstruction, replace some abutting sidewalk and driveway approaches, grading, and storm drainage facilities where needed. (Nonassessable Alley Paving Fund 31-523---212-0001 -- $49,080; Assessable Alley Paving Fund 71-523---212-0001 -- $46,790)

 

5th Aldermanic District

Atkinson Ave., N. 12th St. and N. 13th St. (887-0868-6) File Number 960092: Concrete alley pavement reconstruction, replace some abutting sidewalk and driveway approaches, grading, and storm drainage facilities where needed. Whereas, The report of the Commissioner of Public Works has been filed with the City Clerk; and

 

Whereas, Notices have been sent to all interested persons and public hearings held; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works' Report, as amended at said Public Hearing, is approved and the properties therein identified are benefited; and, be it

 

Further Resolved, That said Commissioner of Public Works is authorized and directed to proceed with said work in accordance with said report pursuant to Section 66.60 and any other pertinent sections of the Wisconsin Statutes and in the manner directed by Section 115-42 of the Milwaukee Code of Ordinances; and, be it

 

Further Resolved, That the proper departments take such action as is required of them to assess the abutting or adjacent properties and collect such assessment in the manner directed by Section 115-42 of the Milwaukee Code of Ordinances; and, be it

 

Further Resolved, That the City Comptroller is authorized and directed to transfer such funds which are available for this purpose to the appropriate capital propose subaccounts; and, be it

 

Further Resolved, That the projects do not involve any parcels of land which are eligible for deferred special assessments under the provisions of Section 14.30 of the Milwaukee City Charter; and, be it

 

Further Resolved, That upon request of property owner (tax key number 334-9991-8) the special assessments for sanitary and storm sewers and water main in N. 98th St. (811-0020-7 and 829-4592-5, respectively) be deferred until application for connection to said sanitary and storm sewers and water main is made. Cost for deferred charges shall be in accordance with City Charter 12-10, and 14-18 respectively; and, be it

 

Further Resolved, That projects W. Dean Rd. (N/S) (878-0750-5); N. 98th St. (811-0020-7); N. 98th St. (829-4592-5); Alley W. Abert. Pl. (887-0868-6); Alley W. Highland Blvd. (886-0625-7) will be billed after January 1, 2000, but not before 12 months after the project contract has been completed; and, be it

 

Further Resolved, That by the Common Council of the City of Milwaukee that a variance is authorized from the procedures of File Number 881665, being the Administrative Rules for the Capital Improvements Process, and hereby directs the City Comptroller to make a supplemental appropriation of $1,710 in the Assessable Water Fund Account (42-641---201-0001) with offsetting revenues in Water Estimated Revenue (42-641---201-9008); and be it

 

Further Resolved , That the City Comptroller is hereby authorized to make the necessary funding and accounting entries, including increasing the Milwaukee Water Works' Assessable Water Fund Account and offsetting revenues to appropriately reflect the intent of this action and assure adequate cost recovery.

 

Further Resolved, That the following project be cancelled from the 1998 Paving Program: 11th Aldermanic District S. 66th St. - W. Kinnickinnic River Pkwy. to W. Montana St. (878-0757-3) File Number 970181
