Avenue, which is proposed to be vacated, in the 14th

Passage of this resolution will vacate a portion of an
improved street needed for the Lake Parkway freeway
construction.
BODY:
Whereas, A resolution directing a report on the
proposed vacation was presented to the Common Council
of the City of Milwaukee by the City of Milwaukee on
the 7th day of November, 1994 for the vacation of
Parcel No. 214, the east side of South Bay Street,
extending from the southerly line of East Potter Avenue
to the northerly line of East Russell Avenue, in the
14th Aldermanic District (17-325); and
 
Whereas, A resolution directing a report on the
proposed vacation was passed by the Common Council on
December 20, 1994 under File No. 941118; now,
therefore, be it
 
Resolved, By the Common Council of the City of
Milwaukee that the fee of $218.00 otherwise required to
be paid to the City Treasurer be and hereby is waived,
and the City Treasurer be and hereby is authorized to
waive said fee pursuant to Ordinance 234 of the City of
Milwaukee, passed July 11, 1961; and, be it
 
Further Resolved, By the Common Council of the City of
Milwaukee that the following described street to-wit:
 
That part of South Bay Street in the Northeast 1/4 of
Section 9, Township 6 North, Range 22 East, described
as follows: Commencing at the point of intersection of the
Westerly line of the Chicago and Northwestern
Transportation Company right-of-way and the westerly
extension of the northerly line of East Russell Avenue
from the east; thence North 22 deg. 24 min. 04 sec.
West, along said Westerly right-of-way line, 405.29 feet
to a point of curve; thence Southerly 112.48 feet along
the arc of said curve whose radius is 300.05 feet with
its center lying to the west having a central angle of
21 deg. 28 min. 42 sec. and whose chord bears South 11
deg. 39 min. 43 sec. East, 111.82 feet to a point;
thence South 18 deg. 47 min. 46 sec. East, 300.60 feet
to a point, said point lying 74.06 feet northwesterly
of, as measured normal to, the Southerly line of East
Russell Avenue; thence North 61 deg. 02 min. 02 sec.
East parallel to said Southerly line, 40.00 feet to the
point of commencement
 
be and the same is hereby vacated for the reason that
the same is of no public utility and the public
interest requires the same to be vacated; and, be it
 
Further Resolved, That as provided by Section 80.32(4)
of the Wisconsin Statutes, such vacation shall not
terminate the easements and rights incidental thereto
acquired by or belonging to any county, town, village
or city, or to any utility or person in any underground
structures, improvements or services, as enumerated or
otherwise existing in said street and in said
description of land above described, both easements and
rights and all rights of entrance, maintenance,
construction and repair of entrance, maintenance,
construction and repair with reference thereto shall
continue as if such street had not been vacated; and,
be it
 
Further Resolved, By the Common Council of the City of
Milwaukee that the Commissioner of Public Works be and
hereby is directed, within two months from the date of
the adoption of this resolution, to view the aforesaid
portion of said street vacated, and assess the benefits
and damages accruing or arising from said vacation, and
to make his report of his assessment of such benefits
and damages to the Common Council of the City of
Milwaukee.
