This substitute resolution authorizes the City to enter into a Streetscape Agreement with the developers of the Library Hill Apartments to construct sidewalks and planters around their project and to fund DPW-related activities associated with this project.
BODY:
Whereas, The Common Council of the City of Milwaukee via File No. 951496 adopted on February 13, 1996, entered into a Development Agreement with the Milwaukee Redevelopment Corporation ("MRC") for the development of the Westown Housing Project ("Development Agreement"); and
Whereas, MRC's successor in interest to the Development Agreement is The Partnership to Develop Westown, Inc., a Wisconsin not-for-profit corporation ("Developer"); and
Whereas, All involved parties desire to have the Developer construct certain public improvements ("Street Improvements") consisting primarily of sidewalks and planters surrounding the Library Hill housing development; and
Whereas, The City of Milwaukee through the Department of Public Works will undertake certain streetscape activities; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the proper City officials are authorized and directed to enter into a Streetscape Agreement with The Partnership to Develop Westown, Inc., under the terms and conditions as outlined in Exhibit A, a copy of which is attached to this Common Council File; and, be it
Further Resolved, That the Commissioner of the Department of Public Works is authorized and directed to undertake any necessary activities to complete the installation of City-owned streetscape improvements such as decorative lighting; and, be it
Further Resolved, That the City Comptroller is directed to transfer $250,000 from Bond Account No. 9990-UR03390000 to Parent Account No. 1910-UR03390000 for the purpose of funding these activities; and, be it
Further Resolved, That the City Attorney is directed to draft a Streetscape Agreement consistent with the terms outlined in Exhibit A.
