- Analysis -

 

This resolution grants permission for the Wisconsin Department of Transportation to install an underground communication/data cable in conduit across and beneath various public rights-of-way to provide a communication link between various freeway rights-of-way, and also between freeway right-of-way and their facilities located at 633 West Wisconsin Avenue and at the Milwaukee County Public Safety Building at 821 West State Street. The purpose of this conduit system is to provide an interconnect between various elements of traffic management equipment.

 

 

BODY:

Whereas, Information regarding the freeway traffic monitoring system operated by WISDOT is currently transmitted over leased overhead and underground lines to their Traffic Operations Center located at 633 West Wisconsin Avenue; and

 

Whereas, WISDOT wishes to install and maintain communication links to be under WISDOT's ownership to replace the leased overhead and underground lines for economic and security reasons; and

 

Whereas, WISDOT also wishes to provide a communication link to the Milwaukee County Public Safety Building at 821 West State Street in order to enhance incident management coordination by integrating directly with Milwaukee County's computer aided dispatch system; and

 

Whereas, The WISDOT has requested permission to install communication/data cable in conduit beneath the public rights-of-way in order to connect various freeway rights-of-way and to connect freeway right-of-way with their facilities at 633 West Wisconsin Avenue and 821 West State Street; and

 

Whereas, Said cable may only occupy the public rights-of-way with Common Council approval; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Wisconsin Department of Transportation is granted permission for the following:

 

To install and maintain communication/data conduit cabling consisting of (2) 4-inch diameter conduits across and beneath the public rights-of-way as follows:

 

1. Beginning at a point on the westline of North James Lovell Street, approximately 125 feet south of the southline of West Michigan Street; then extending northeasterly to a point approximately 85 feet south of the southline of West Michigan Street and 27.5 feet west of the eastline of North James Lovell Street; then extending in a northerly direction across West Michigan Street to a point approximately 60 feet south of the southline of West Wisconsin Avenue; then extending east connecting to the building at 633 West Wisconsin Avenue.

 

2. Beginning at a point on the westline of North 10th Street, approximately 40 feet south of the southline of West State Street; then extending northeasterly to a 24-inch X 36-inch pull box located approximately 30 feet south of the southline of West State Street and 10 feet east of the westline of North 10th Street; then extending northeasterly to a 24-inch X 36-inch pull box located at the southeast corner of North 10th Street and West State Street, within a median area between thesouthline of West State Street and the north curb of an access road south of West State Street, between North 9th Street and North 10th Street; then extending easterly in this median area to a 24-inch X 36-inch pull box located in the sidewalk area at the southwest corner of North 9th Street and West State Street; then crossing North 9th Street to a 24-inch X 36-inch pullbox located in the sidewalk area at the southeast corner of North 9th Street and West State Street and continuing easterly in the south sidewalk area of West State Street to a 24-inch X 36-inch pullbox located approximately 200 feet east of the eastline of North 9th Street and 4 feet north of the southline of West State Street; then extending south connecting to the building at 821 West State Street.

 

3. At the following four locations:

 

a.                     Beginning at a point on the westline of South 84th Street, approximately 20 feet south of the southline of West O'Conner Street; then extending easterly across South 84th Street to a point on the eastline of South 84th Street, approximately 20 feet south of the southline of West O'Conner Street.

 

b.                     Beginning at a point on the westline of North 13th Street, approximately 70 feet south of the southline of West Clybourn Street; then extending easterly across North 13th Street to a point on the eastline of North 13th Street, approximately 60 feet south of the southline of West Clybourn Street.

 

c.                     Beginning at a point on the westline of North Hibernia Street, approximately 150 feet southeast of the southline of West Tory Hill; then extending northeasterly across North Hibernia Street to a point on the eastline of North Hibernia Street, approximately 150 feet southeast of the southline of West Tory Hill.

 

d.                     Beginning at a point on the westline of North 10th Street, approximately 150 feet south of the southline of West Tory Hill; then extending easterly across North 10th Street to a point on the eastline of North 10th Street, approximately 150 feet south of the southline of West Tory Hill.

 

The conduit will be a minimum of 3 feet below grade.

 

and, be it

 

Further Resolved, By the Common Council of the City of Milwaukee, that the Commissioners of Public Works and Building Inspection are hereby authorized and directed to issue the necessary permits for installation of the underground communication/data cabling package beneath the public rights-of-way; and, be it

 

Further Resolved, That this permission is granted only on the following conditions:

 

1. That the Wisconsin Department of Transportation shall hold the City of Milwaukee or its agents harmless and accept responsibility for any and all liabilities that may arise through implementation of the permission granted herein.

 

2. That the contractor(s) hired to install the permitted facilities shall obtain the necessary Department of Public Works and Building Inspection permits prior to installation of the facilities. All normal and customary permit fees and deposit requirements will be applied.

 

3. Grantee shall be responsible for the protection, adjustment, and/or relocation of the facilities as necessary to accommodate any future public improvement projects approved by the Common Council.

 

4. Neither the facilities hereby permitted nor the information transmitted by way of these facilities, shall be used for the purpose of generating revenue for the grantee.

 

5. Whenever the cable is no longer needed or when so ordered for public necessity, grantee shall not only remove the cable, but shall also restore to the approval of the Commissioner of Public Works any curb, pavement or other public improvement which was removed, changed or disturbed by reason of the granting of this resolution. Said grantee shall not be entitled to any damages for such removal.

 

6. The grantee shall not assign any of the rights hereby granted without Common Council action approving an amendment to this resolution.
