This resolution authorizes the Community Relations - Social Development Commission to exercise administrative and supervisory functions with respect to the Weed and Seed programs funded by the United States Departments of Housing and Urban Development and Justice and the State of Wisconsin Department of Justice for 1996, 1997, 1998 and authorizes the Block Grant Director to execute contracts on behalf of the City of Milwaukee with the Community Relations - Social Development Commission. _______________________________________________________
 
BODY:
Whereas, The City of Milwaukee has received funding for the Weed and Seed grant activity from the United States Department of Justice (DOJ), Grants numbered: 95-DD-BX-0092; 96-WS-QX-0011; 97-WS-QX-0034; and
 
Whereas, The Common Council in CCFN 971831 and CCFN 971832 has approved the application, acceptance and funding for the 1998 Community Security Partnerships Grant and the 1998 Weed and Seed Expansion Grant, respectively, for weed and seed and safe haven activity from the U. S. Department of Justice, (referred to, collectively with the DOJ grants listed above, as the "DOJ funds"); and
 
Whereas, The Common Council in CCFN 970937 has approved Community Development Block Grant (CDBG) funding for output "City 3A" in the amount of $265,000 for 1998 Weed and Seed Program administration and safe haven activity (referred to as the "HUD funds"); and
 
Whereas, The Common Council in CCFN 971883 has approved the submission of application for State of Wisconsin Weed and Seed funds in the amount of $250,000; and
 
Whereas, There remains $5,681 unspent from 1996-97 funds from the State of Wisconsin for Weed and Seed Program administration and safe haven activity (referred to, collectively with State of Wisconsin grant listed above, as the "STATE funds"); and
 
Whereas, The DOJ funds and the HUD funds and the STATE funds are collectively known as the "Weed and Seed Program"; and
 
Whereas, The Safe and Sound Program (formerly known as the Youth, Crime and Violence Initiative) is being used to coordinate crime fighting and crime prevention in cooperation with the Milwaukee Public Schools, the U.S. Attorney's office, and the Milwaukee Police Department; and
 
Whereas, The Youth, Crime and Violence Task Force established March 16, 1998, is expanding the scope of the Weed and Seed Program model to an area encompassing the existing Weed and Seed target areas identified in applications submitted to and approved by the U. S. Department of Justice; and
 
Whereas, It is the desire of the Common Council of the City of Milwaukee to coordinate its crime fighting efforts and crime prevention activities by centralizing the administration and staffing for the Safe and Sound Program including the Weed and Seed program; and
 
Whereas, The Board of Directors of the Community Relations - Social Development Commission (SDC) has approved the assumption by SDC of responsibility for the administrative and supervisory functions for the Weed and Seed Program; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee that the administrative and supervisory functions for the Weed & Seed Program be undertaken by SDC effective as of July 1, 1998; and
 
Further Resolved, That the balance of HUD funds, DOJ funds and STATE funds either anticipated as listed above or remaining available on July 1, 1998 and previously allocated to the Community Block Grant Administration (CBGA) for Weed and Seed Program administrative and supervisory functions and safe haven activity in 1998 be reallocated and awarded to SDC for 1998; and
 
Further Resolved, That the City Comptroller is authorized to:
 
1. Create a Special Revenue Fund - Grant and Aid Projects and the necessary expenditure and revenue accounts; appropriate to these accounts the amount required under the grant agreements;
 
2. Transfer appropriations from the CBGA Administration Accounts and currently existing operating grant expenditure accounts to SDC accounts in the amount required under the grant agreement and transfer the corresponding offsetting estimated revenue;
 
3. Establish the necessary grant performance submeasures;
 
and, be it
 
Further Resolved, That the Director of the Community Block Grant Administration (CBGA) be authorized and directed to negotiate and enter into contracts with SDC on behalf of the City providing for the allocation of funds authorized in the preceding paragraph and providing for performance by SDC, effective as of July 1, 1998, of administrative and supervisory functions for the balance of all remaining Weed and Seed Program funding received from the United States Departments of Justice, Housing and Urban Development (HUD) and the State of Wisconsin Department of Justice for 1996, 1997 and 1998; and, be it
 
Further Resolved, That all subcontracts heretofore entered into and awarded by CBGA for safe haven activity be canceled and restated so as to be administered by SDC, effective July 1, 1998, for the balance of the contract awards subject to any terms and conditions required pursuant to the contracts between the City and SDC described in the preceding paragraph; and, be it
 
Further Resolved, That the Community Block Grant Administration is authorized to accept the 1998 State Weed and Seed funds without further approval unless the terms of the grant change as indicated in Common Council file 940843; and, be it
 
Further Resolved, That the City Comptroller is authorized to encumber in the parents accounts of the 1998 Special Revenue Accounts - Grant and Aid Projects, the following amounts for the Project titled: 1998 State Weed and Seed Program:

Further Resolved, That $175,000 of the State of Wisconsin funding for Weed and Seed Program activity in 1998 be appropriated to CBGA which is authorized to:
 
1. Expend from the amount appropriated sums for specified purposes as indicated in the grant budget and incur costs consistent with the award date
 
2. Enter into a subcontract with SDC as described in the approved application of the City dated April 14, 1998 and filed with the Wisconsin Department of Justice;
 
and, be it
 
Further Resolved, That $75,000 of the State of Wisconsin funding for Weed and Seed Program activity in 1998 be appropriated to the Milwaukee Police Department which is authorized to:
 
1. Expend from the amount appropriated sums for specified purposes as indicated in the grant budget and incur costs consistent with the award date;
 
2. Enter into contracts and leases as detailed in the grant budget;
 
3. Expend sums from the grant budget for equipment;
 
and, be it
 
Further Resolved, That U. S. Department of Justice funding applied for as approved in CCFN 971831 and 971832 be appropriated to CBGA which is authorized to:
 
1. Expend from the amount appropriated sums for specified purposes as indicated in the grant budget and incur costs consistent with the award date;
 
2. Enter into a subcontract with SDC described in the approved application of the City dated March 13, 1998 and filed with the U. S. Department of Justice;
 
and, be it
 
Further Resolved, That these departments/agencies are required to submit budget and activity reports in amounts and according to any conditions approved by the Common Council and the Mayor in conformance with File Number 74-92-5v to the Community Block Grant Administration and the City Comptroller for their review and approval; and, be it
 
Further Resolved, That payments for Weed and Seed Program costs incurred shall be paid in accordance with approved CDBG reimbursement policy based on the approval by the Community Block Grant Administration and City Comptroller of a Budget Forecast (CDA-51).
