Title

Resolution relating to acceptance and funding of a Green Infrastructure Partnership Program grant from Milwaukee Metropolitan Sewerage District for the removal of impervious surface and installation of green infrastructure on South 1st Street between West Lincoln Avenue and South Chase Avenue, and authorizing entry into a post installation Maintenance Covenant with Milwaukee Metropolitan Sewerage District, in the 12th and 14th Aldermanic Districts.

Analysis

This resolution authorizes the Department of Public Works, Infrastructure Services Division, to accept a Milwaukee Metropolitan Sewerage District Green Infrastructure Partnership Program grant funding for the removal of impervious pavement and installation of green infrastructure consisting of native landscaping, trees and bioswales. The resolution also authorizes the Commissioner of Public Works to execute a post installation Maintenance Covenant with the Milwaukee Metropolitan Sewerage District.

Body

Whereas, The Milwaukee Metropolitan Sewerage District (MMSD) is responsible for collecting and treating wastewater from local sewerage systems; and

 

Whereas, Green infrastructure reduces the volume of stormwater in the sewer system and the amount of pollutants discharged to surface waters; and

 

Whereas, The City proposes removal of impervious pavement and installation of green infrastructure consisting of native landscaping, trees and bioswales along South 1st Street between West Lincoln Avenue and South Chase Avenue; and

 

Whereas, Said green infrastructure will aid MMSD in its goal to capture the first half inch of rainfall as well as providing water quality benefit in compliance with the City’s stormwater discharge permit with the Department of Natural Resources (DNR);

 

Whereas, MMSD desires to promote the installation of such green infrastructure practices and is willing to provide the City funding as part of its Green Infrastructure Program; and

 

Whereas, The funding agreement also requires that after the completion of construction of said green infrastructure, the City of Milwaukee will execute a maintenance covenant in favor of the MMSD; and

Whereas, A template Maintenance Covenant to be used post-installation is submitted to this file; now, therefore, be it

 

Resolved, That the Commissioner of Public Works is authorized to accept MMSD Green Infrastructure Funding in accordance with Milwaukee Code of Ordinances 304-81; and, be it

 

Further Resolved, That the Green Infrastructure funding agreement (G98022P04) and the template maintenance covenant submitted to this file are hereby approved, and City personnel, including the DPW Commissioner, are authorized: (i) to cause the City to enter those documents in the same form, or in substantially the same form and substance, as have been submitted to this file; and (ii) to take such further acts as may be contemplated or required to be taken by the City thereunder so as to carry out the intent and purpose of this resolution and those documents; and, be it

 

Further Resolved, That upon approval of this Agreement, the City Comptroller is authorized to create within the Capital Grant and Aid Projects Fund the appropriate Project/Grant Chartfield Value for this project, and transfer to these accounts the amount required under the agreement and City accounting policy, but not to exceed a ten percent increase of the total amounts reserved for the grantor’s share and local share or $5,000, whichever is greater, as follows:

; and, be it

 

Further Resolved, That these funds are appropriated to the Department of Public Works, which is authorized to expend from the amount budgeted for specific purposes as indicated in the grant budgets and incur costs consistent with the award date; and, be it

 

Further Resolved, That the Commissioner of Public Works shall have the authority to authorize transfers within the project budget so long as the amount expended for any purpose shall not exceed the amount authorized by the budget by 10% and such transfers are in accordance with grantor regulations; and, be it

 

Further Resolved, That the Commissioner of Public Works, on behalf of the City of Milwaukee, is authorized to enter into subcontracts (and leases) as detailed in the project budget and in accordance with City purchasing procedures and grant and aid guidelines for awarding such contracts.
