Resolution authorizing the proper City officers to execute an Out-of-Program Agreement between Hallie Rapids LLC and the City of Milwaukee for construction of public improvements to serve a Comfort Suites hotel to be located north of West Good Hope Road and west of North 107th Street.
ANALYSIS
This resolution authorizes City officers to execute an Out-of-Program Agreement. The agreement is between Hallie Rapids LLC and the City and pertains to the design, construction, construction inspection, and funding of public improvements to serve a new Comfort Suites hotel to be located north of West Good Hope Road and west of North 107th Street. Under the terms of the agreement, the Developer will cover the entire cost for the required public improvements. Design and construction of the improvements may be undertaken by either the Department of Public Works or the Developer if approved by the Commissioner of Public Works. Any plans prepared by the developer must be approved by the Commissioner. DPW will inspect all public works construction activity.
BODY
Whereas, Hallie Rapids LLC, a developer, desires to enter into an Out-of-Program Agreement with the City of Milwaukee regarding the design, construction, and funding of a sanitary sewer extension to serve a new Comfort Suites hotel to be located north of West Good Hope Road along the west side of North 107th Street; and
Whereas, The Out-of-Program Agreement for the proposed hotel project is attached to this file; and
Whereas, Under the terms of the agreement, the required sewer extension will be designed and installed at no cost to the City; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Out-of-Program Agreement attached to this file is hereby approved and the proper City officers are hereby authorized to execute said agreement on behalf of the City; and, be it
Further Resolved, That the Commissioner of Public Works is authorized to accept funds from the Developer as outlined in the Out-of-Program Agreement for the purpose of design engineering and for the purpose of constructing and inspecting the planned public improvements; and, be it
Further Resolved, That the Commissioner is authorized to make minor, non-substantive changes to the Out-of-Program Agreement prior to its execution.
