Title

Resolution consenting to the termination of the common ownership requirement of the properties located at 1245-47 and 1233 North Water Street as it relates to an existing restrictive covenant, in the 4th Aldermanic District.

Analysis

This resolution authorizes the City of Milwaukee’s consent to the termination of a common ownership restriction of properties located at 1245-47 and 1233 North Water Street and the release of the existing restrictive covenant. The City of Milwaukee’s consent is required pursuant to a restrictive covenant placed on the properties by the former owner at the request of the City in order to comply with the then- applicable off-street parking requirements.

Body

Whereas, On December 30, 1986, the former owner of 1245-47 and 1233 North Water Street (“Properties”) executed a Designation of Restriction requiring common ownership of the Properties in order to comply with ordinances regarding off-street parking (“Restriction”); and

 

Whereas, The Restriction was recorded on the title for the Properties with the Register of Deeds for Milwaukee County, Wisconsin on January 2, 1987, Reel 2019, Image 877 as Document Number 6005087; and

 

Whereas, The Restriction was executed at the request of the City and may only be released and discharged with the City’s consent; and

 

Whereas, The Properties are under common ownership as required by the Restriction; and

 

Whereas, the current zoning of the Properties no longer requires off-street parking, making the Restriction unnecessary; and

 

Whereas, The current owner of the Properties wishes to convey the Properties to separate buyers and has requested the City’s consent to the termination of the common ownership requirement and authorizing the execution and recordation of this termination; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that it consents to the termination of the common ownership requirement of the Properties located at 1245-47 and 1233 North Water Street; and, be it

 

Further Resolved, By the Common Council of the City of Milwaukee, that it consents to release the Restriction; and, be it

 

Further Resolved, That the City Clerk, City Attorney, and any other relevant City officials are directed to take whatever actions are necessary and execute all documents needed to release the Restriction.
