Title

Resolution to authorize the City Attorney’s Office to intervene on behalf of the City before the Public Service Commission of Wisconsin regarding the application of the Wauwatosa Water Utility to acquire existing water facilities from Milwaukee County.

 

Analysis

This Resolution authorizes the City Attorney’s Office to intervene on behalf of the City before the Public Service Commission of Wisconsin regarding the application of the Wauwatosa Water Utility to acquire existing water facilities from Milwaukee County.

 

Body

Whereas, The City of Wauwatosa and the Wauwatosa Water Utility (“Wauwatosa”) filed an application for Public Service Commission of Wisconsin approval to acquire water supply facilities currently owned by Milwaukee County; and

 

Whereas, Milwaukee County owns and operates water system assets located on the Milwaukee County Grounds and serving the Milwaukee Regional Medical Center campus and certain Wauwatosa retail water customers; and

 

Whereas, Milwaukee County has recently sold the Milwaukee County Grounds property to members of the Milwaukee Regional Medical Center and wishes to divest itself of the water and sewer facilities located on the Milwaukee County Grounds property as it no longer owns the real property served by the water assets; and

 

Whereas, Wauwatosa and Milwaukee County purchase wholesale water from the City of Milwaukee pursuant to wholesale water service agreements that delineate each wholesale customer's service area; and

 

Whereas, Milwaukee Water Works will remain the wholesale water provider and the amount of water sold by Milwaukee Water Works is not anticipated to change if Wauwatosa’s application is approved; and

 

Whereas, It is anticipated that, if Wauwatosa’s application is approved, the wholesale water service agreement between Wauwatosa and the City would need to be amended; and

 

Whereas, intervention in this or any other related Commission proceeding regarding Wauwatosa’s application to acquire water supply facilities currently owned by Milwaukee County will help to protect the interests of the City, operating as a water public utility; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the City Attorney’s Office is authorized to intervene on behalf of the City before the Public Service Commission of Wisconsin regarding the application of the Wauwatosa Water Utility to acquire existing water facilities from Milwaukee County and to protect the City’s interests in that or any other related proceeding.
