Analysis
This resolution authorizes and directs the proper City officers to execute two Partial Sewer Easement Releases, three Sewer Easement Releases, and four Quitclaim Deeds.
Body
Whereas, In October 1973, the City of Milwaukee (City) was granted easement SE-2067, for sewer purposes in an area located in Vacated South 29th Street from a point 310 feet north of West Oklahoma Avenue to West Oklahoma Avenue; and
Whereas, In September 1975, the City was granted an easement SE-2128 for sewer purposes in an area located in Vacated South 29th Street from a point 772 feet north of West Oklahoma Avenue to a point 265 feet north of West Oklahoma Avenue; and
Whereas, There are existing 20-inch diameter and 15-inch diameter sanitary sewers in said easement SE-2128; and
Whereas, In December 1978, the City was granted an easement SE-2231 for sewer purposes in an area located in Vacated South 29th Street from a point 310 feet north of West Oklahoma Avenue to West Oklahoma Avenue ; and
Whereas, There is an existing 20-inch diameter sanitary sewer in said easement SE-2231; and
Whereas, In November 1992, the City was granted easement SE-2577 and WE-733 for sewer and water purposes in an area located in Vacated South 29th Street from West Kinnickinnic River Parkway to a point 150 feet south of West Kinnickinnic River Parkway; and
Whereas, There is an existing 15-inch diameter sanitary sewer in said easement SE-2577 and an existing 8-inch diameter water main in said easement WE-755; and
Whereas, In March 2001, the City was granted an easement SE-2688 for sewer purposes in an area located in the Vacated South 29th Street from a point 675 feet north of West Oklahoma Avenue to a point 259 feet north of West Oklahoma Avenue; and
Whereas, The Owner has paid to install a new public sanitary sewer in West Kinnickinnic River Parkway to replace the existing sanitary sewer in Vacated South 29th Street; and
Whereas, The Owner has requested conveyance of the aforementioned sewers within SE-2128 SE-2231 SE-2577 and SE-2688; and
Whereas, The City has determined that the sewers within easements SE-2128, SE-2231, SE-2577 and SE-2688 no longer serve the interest of the City of Milwaukee and therefore can be conveyed; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the proper City officers are hereby authorized and directed to execute the documents for Sewer Easement Releases SER-2128, SER-2231 and SER-2668, Partial Sewer Easement Release SER-2067, Partial Sewer Easement Release SER-2577/WER-733 and Quit Claim Deeds QCD-2128, QCD-2231, QCD-2577 and QCD-2688, copies of which are attached to the Common Council Resolution File Number 020384 and incorporated in this resolution by reference as though set forth in full; and, be it
Further Resolved, That after said Sewer Easement Releases, Partial Sewer Easement Releases and Quit Claim Deed documents have been executed by the proper City officers, the documents shall be forwarded to the office of the City Attorney for approval as to execution and, then to the office of City Real Estate for recording and proper distribution.
