Analysis

This resolution approves a Maintenance Agreement between the City of Milwaukee and the Miller Brewing Company.  Miller has proposed construction of various streetscape amenities in and adjacent to the public right-of-way of West State Street through its corporate campus (North 37th to North 46th Streets).  The Maintenance Agreement outlines maintenance responsibilities for these streetscape amenities.  Generally, Miller will be responsible for maintenance of any unique improvements while the City will maintain standard and customary improvements such as harp lights. 

Body

Whereas, The Miller Brewing Company has proposed that a variety of specialized streetscape amenities be installed in conjunction with the reconstruction of West State Street through the company's corporate campus; and

Whereas, The City of Milwaukee has secured on the company's behalf an Enhancement Grant from the State of Wisconsin which covers 80% of the cost of the streetscape amenities with the City providing the remaining 20%; and

Whereas, The planned improvements include special paving materials, street lighting attached to a building awning, and traditional Milwaukee harp lights; and

Whereas, Typically the City requires the proponents of specialized streetscape improvements to be responsible for the maintenance of such improvements; and

Whereas, A Maintenance Agreement between the City of Milwaukee and the Miller Brewing Company has been prepared and is attached to the file; and

Whereas, This agreement outlines which improvements the company will maintain and which will be maintained by the City; and

Whereas, Per the City's usual practice, the company will be responsible for maintaining the streetscape improvements not normally incorporated into a City paving project; now, therefore, be it

Resolved, That the Common Council of the City of Milwaukee hereby approves the Maintenance Agreement attached to this file between the City of Milwaukee and the Miller Brewing Company and directs the appropriate City officials to execute the agreement on the City's behalf; and, be it

Further Resolved, That the Commissioner of Public Works is authorized to make minor, non-substantive changes to the agreement prior to its execution.
