Resolution to vacate North 7th Street from West Highland Avenue to a point south, North 7th Street from West Juneau Avenue to a point south and the east-west alley in the block bounded by West Highland Avenue, West Juneau Avenue, North 7th Street and North 8th Street in the 4th Aldermanic District. BODY:

Whereas, A petition was presented to the Common Council of the City of Milwaukee by Milwaukee Area Vocational, Technical and Adult Education District and others on the 17th day of December, 1996 for the vacation of North 7th Street from West Highland Avenue to a point south, North 7th Street from West Juneau Avenue to a point south and the east- west alley in the block bounded by West Highland Avenue, West Juneau Avenue, North 7th Street and North 8th Street; now, therefore be it

 

Further Resolved, By the Common Council of the City of Milwaukee, that said petition be and the same is hereby granted and that the following described portion of said street and alley; to-wit:

 

North 7th Street from West Highland Avenue to a point south

 

All that part of North 7th Street, as presently open, in the Northwest 1/4 of Section 29, Township 7 North, Range 22 East, described as follows: Commencing at the present northwest corner of Lot 6 in Block 164 of Plat of East Half, a recorded subdivision, in said 1/4 Section; thence Southerly along the east line of North 7th Street, to the present northwest corner of Lot 11 in said Block 164; thence Westerly to the present northeast corner of Lot 16 in Block 163 of said subdivision; thence Northerly, along the west line of North 7th Street, to the present northeast corner of Lot 1 in said Block 163; thence Easterly to the point of commencement.

 

North 7th Street from West Juneau Avenue to a point south

 

All that part of North 7th Street, as presently open, in the Northwest 1/4 of Section 29, Township 7 North, Range 22 East, described as follows: Commencing at the present northwest corner of Lot 6 in Block 159 of Plat of East Half, a recorded subdivision, in said 1/4 Section; thence Southerly, along the east line of North 7th Street, to the present northwest corner of Lot 7 in said Block 159; thence Westerly to the present northeast corner of Lot 8 in Block 160 of said subdivision; thence Northerly, along the west line of North 7th Street to the present northeast corner of Lot 1 in said Block 160; thence Easterly to the point of commencement.

 

ALLEY

 

All of the northerly 15-foot wide east-west alley, as presently open, in Block 160 of Plat of East Half, a recorded subdivision, in the Northwest 1/4 of Section 29, Township 7 North, Range 22 East, described as follows: Commencing at the present northeast corner of Lot 8 in said Block; thence Westerly, along the south line of said alley to the present northwest corner of Lot 7 in said Block; thence Northerly to the present southwest corner of Lot 6 in said Block; thence Easterly, along the north line of said alley, to the present southeast corner of Lot 1 in said Block; thence Southerly to the point of commencement.

 

be and the same hereby is vacated for the reason that the same is of no public utility and the public interest requires the same to be vacated; and be it

 

Further Resolved, That as provided by Section 80.32(4) of the Wisconsin Statutes, such vacation shall not terminate the easements and rights incidental thereto acquired by or belonging to any county, town, village or city, or to any utility or person in any underground structures, improvements or services, as enumerated or otherwise existing in said streets and alley and in said description of land above described, but such easements and rights and all rights of entrance, maintenance, construction and repair with reference thereto shall continue as if such streets and alley had not been vacated; and be it

 

Further Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works be and he is hereby directed, within two months from the date of the adoption of this resolution, to view the aforesaid portion of said streets and alley vacated, and assess the benefits and damages accruing or arising from said vacation, and to make his report of his assessment of such benefits and damages to the Common Council of the City of Milwaukee, as required by law.
