Resolution authorizing the proper City officers to execute an Out-of-Program Agreement between Cedar Development LLC and the City of Milwaukee for design, installation, and inspection of public improvements to serve a single-family residential subdivision located on the south side of West County Line Road at approximately North 95th Street.  (DPW)
Analysis
This resolution approves an Out-of-Program Agreement between Cedar Development LLC and the City of Milwaukee.  Cedar Development plans to develop a single-family home subdivision south of West County Line Road at approximately North 95th Street.  Under the terms of the Out-of-Program Agreement, Cedar Development will prepare the public improvement plans for the subdivision, the City's Department of Public Works will review and approve the plans, the Developer will contract for public improvement construction, and the Department of Public Works will inspect all the public improvement work.  All costs will be the responsibility of the Developer.
Body
Whereas, Cedar Development LLC proposes to develop a single-family home subdivision on the south side of West County Line Road at approximately North 95th Street; and
 
Whereas, An Out-of-Program Agreement pertaining to the design, installation, inspection, and funding of public improvements for this subdivision has been prepared and is attached to this file; and
 
Whereas, The Developer has proposed constructing a rural cross section street with open stormwater drainage ditches and no sidewalks; and
 
Whereas, Under the terms of that agreement, the proposed public improvements would be designed and installed at no cost to the City of Milwaukee; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the Out-of-Program Agreement attached to this file is hereby approved and the proper City officers are hereby authorized to execute said Agreement on behalf of the City of Milwaukee; and, be it
 
Further Resolved, That the Commissioner of Public Works is authorized to accept funds from the Developer to perform all the functions listed in the Out-of-Program Agreement; and, be it
 
Further Resolved, That the requirements of City Code Section 113-12.5 pertaining to sidewalk installation in conjunction with new City streets are hereby waived for subdivision covered by this resolution; and, be it
 
Further Resolved, That the Commissioner is authorized to make minor, non-substantive changes to the Out-of-Program Agreement prior to its execution.
