Title

Substitute resolution authorizing and directing the proper City officers to execute a Permit and Agreement document allowing the NEW WAICO Development Corporation to construct portions of buildings within the limits of the sewer easement on the property at 1800 North 12th Street.

Analysis

This resolution authorizes and directs the proper City officers to execute the Permit and Agreement SA-2105E and WA-387E, located in West Vine Street between North 11th Street and North 12th Street.

Body

Whereas, On October 21, 1974 the City was granted an easement SE-2105E and WE-387E for sewer and water purposes in West Vine Street between North 11th Street and North 12th Street; and

Whereas, Said easement is located on lands presently owned by NEW WAICO Development Company (the Owner); and

Whereas, The Owner has requested the City's permission to construct portions of a building in and over a portion of the easement area; and

Whereas, The City will allow the construction of said portions of the building in and over a portion of the easement area, subject to conditions stipulated in Permit and Agreement document known as SA-2105E and WA-387E; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the proper City officers are hereby authorized and directed to execute Permit and Agreement SA-2105E and WA-387E, said Permit and Agreement being attached to Common Council File Number 020780 and incorporated in this resolution by reference as though set forth in full; and, be it

Further Resolved, That after said Permit and Agreement document has been executed by the proper City officers, it shall be forwarded to the office of the City Attorney for approval as to form and execution and then to the Department of Public Works for recording and proper distribution.
