Title
A substitute ordinance establishing a pilot resident parking permit program.

Analysis
This ordinance creates a pilot resident parking permit program which shall be in effect from August 27 through November 30, 2001.  Under this program, the following blocks are designated as streets where, on one side of the street, parking between the hours of 8 a.m. and 7 p.m. shall be limited to vehicles displaying resident parking permits:
 
a.  3000 block of North Barlett Street.
 
b.  3400 block of North Cramer Street.
 
c.  3000 block of North Farwell Avenue.
 
d.  3300 block of North Hackett Avenue.  
 
The city clerk shall mail, at no charge to residents, 2 resident parking permits to each dwelling unit located along either side of any of these blocks.  A resident parking permit shall be clearly displayed in the lower left corner of the windshield of any vehicle parked along one of the designated blocks.  Exceptions to this restriction are provided for emergency vehicles and delivery, utility or service vehicles being used to furnish services or deliver goods to properties located along the designated blocks.  The permission to park on a designated block granted by a resident parking permit does not exempt the permit holder or permit holder's vehicle from compliance with all other parking regulations in effect at that location.  Resident parking permits shall be fully transferable from one vehicle to another.
Body
Whereas, Various residential areas of the city experience high demand for on-street parking and limited availability of on-street parking to area residents because of proximity to abutting non-residential uses (e.g., educational institutions, medical facilities and commercial districts) that generate large amounts of traffic and parking demand; and
 
Whereas, Because of this high demand for parking, residents of such residential areas often have concerns about parking availability, traffic safety, emergency-vehicle access and service/delivery vehicle access in their neighborhoods; and
 
Whereas, The Common Council of the City of Milwaukee finds that the creation of a resident parking permit program under which on-street parking on designated blocks would be available only to block residents would be beneficial to the residents of the city of Milwaukee in that it would serve to:
 
1.  Alleviate the hardship experienced by residents in locating reasonably-convenient on-street parking.
 
2.  Increase the availability of parking for guests of residents of these areas.
 
3.  Increase the availability of parking for commercial delivery or service vehicles.
 
4.  Preserve the residential character of residential neighborhoods.
 
5.  Reduce the amount of noise and litter in such areas.
 
6.  Increase public safety in general and traffic safety in particular.
 
7.  Alleviate traffic congestion and illegal parking problems in residential neighborhoods.
 
8.  Improve emergency-vehicle access to dwelling units in such neighborhoods.
 
9.  Enhance the delivery of municipal services in these areas.
 
10.  Discourage commuting by automobile, thereby reducing energy consumption and air pollution.
 
; now, therefore
 
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
 
Part 1.  Section 101-27.8 of the code is created to read:
 
101-27.8  Resident Parking Permit Program.
 
1.  PURPOSE.  The common council finds that various residential areas of the city experience high demand for on-street parking and limited availability of on-street parking to area residents because of proximity to abutting non-residential uses that generate large amounts of traffic and parking demand.  The common council further finds that, in order to insure the availability of on-street parking for neighborhood residents, promote traffic and pedestrian safety, and improve access for emergency vehicles and commercial delivery and service vehicles, it is necessary to designate certain residential blocks in the city as resident parking permit blocks and to generally restrict on-street parking along such blocks to vehicles owned by residents of those blocks, or their guests, and bearing valid resident parking permits.
 
2.  DESIGNATED RESIDENT PARKING PERMIT BLOCKS.  Along each of the following blocks, and between the hours of 8 a.m. and 7 p.m., parking on one side of the block shall be designated for parking by resident parking permit only.  For each block, the commissioner of public works shall determine which side of the street shall be subject to the resident parking permit regulations.  The commissioner shall post appropriate signs along the affected side of the street.
 
a.  3000 block of North Barlett Street.
 
b.  3400 block of North Cramer Street.
 
c.  3000 block of North Farwell Avenue.
 
d.  3300 block of North Hackett Avenue.  
 
3.  PARKING RESTRICTIONS.  a.  General Regulation.  Between the hours of 8 a.m. and 7 p.m., no motor vehicle may be parked or left standing on any block on which parking is restricted to parking by resident parking permit only unless a valid resident parking permit for parking on that block is clearly displayed in the lower left corner of the windshield of the vehicle.
 
b.  Exceptions.  Paragraph a shall not apply to any of the following:
 
b-1.  An emergency vehicle, including but not limited to an ambulance, fire department vehicle or police department vehicle.
 
b-2.  Any vehicle, including but not limited to a delivery, utility or service vehicle, which is being used by a person engaged in the provision of services or delivery of goods to a property located along the designated block, provided the name of the commercial enterprise or public utility providing the service or delivering the goods is clearly identified on the vehicle.
 
c.  Right to Parking Not Guaranteed.  A resident parking permit shall not guarantee or reserve to the holder of the permit a parking space on the block with the resident parking permit restrictions.
 
d.  Compliance With Other Regulations.  A resident parking permit shall not authorize the holder thereof to stand or park a motor vehicle in such places or during such times as the stopping, standing or parking of motor vehicles is prohibited, or in places set aside for specified types of vehicles, nor exempt the holder from the observance of any traffic regulations.
 
4.  PERMITS.  a.  City Clerk to Issue.  The city clerk shall issue and mail, at no charge to residents, 2 resident parking permits to each dwelling unit along the designated blocks.  Permits shall be issued to dwelling units located on both sides of a designated block, even though the resident parking permit regulations only apply on one side of the block.  Such permits shall bear the address of the dwelling unit for which they were issued.
 
b.  Permit Applicability.  A resident parking permit may be used in  any vehicle.  The permit shall be transferable from one vehicle to another.  A resident parking permit shall be valid only for parking along the block on which the corresponding address is located.
 
Part 2.  Section 101-34-2-g of the code is amended to read:
 
101-34.  Stipulation Procedure; Nonmoving Traffic Violations.
 
2.  FORFEITURE SCHEDULE.
 
g.  Citations issued for [[violation of s.]] >>violations of ss.<< 101-23.5 >>and 101-27.8-3-a<<: $40.
 
Part 3.  Section 101-34-7-h of the code is amended to read:
 
7.  PENALTY.
 
h.  Violations of [[s.]] >>ss.<< 101-23.5 >>and 101-27.8-3-a<<: $40 to $60.
 
Part 4.  This ordinance shall be effective August 27, 2001.
 
Part 5.  This ordinance shall be null and void after November 30, 2001.
