Analysis

This resolution declares two City-owned vacant lots surplus to municipal needs and permits the City of Milwaukee to convey property interests to the Milwaukee Metropolitan Sewerage District for the Valley Park Neighborhood Flood Control Project.

Body

Whereas, The Milwaukee Metropolitan Sewerage District ("MMSD") approved the Valley Park Neighborhood Flood Control Project as part of its effort to abate flooding in the Menomonee River Valley; and

 

Whereas, MMSD's project designates for acquisition the fee simple interest in several properties in the flood plain including the City-owned vacant lots at 635 North 40th Street (Tax Key No. 402-0225-1007) and 428-42 North 42nd Street (Tax Key No. 402-0281-000-2); and

 

Whereas, MMSD also has requested a temporary construction easement on the City-owned vacant lot at 4026-28 West Clybourn Street (Tax Key No. 402-0244-000-4); and

 

Whereas, MMSD obtained independent appraisals of the properties and has offered the City of Milwaukee the following amounts:

 

ADDRESS, LAND AREA, INTEREST, OFFERING PRICE

 

635 North 40th Street, 2,800 square feet, Fee Simple, $2,200

 

428-42 North 42nd Street, 16,200 square feet, Fee Simple, $18,000

 

4026-28 West Clybourn Street, 7,800 square feet, Temporary Construction Easement, $900

 

; and

 

Whereas, The City Real Estate Officer has reviewed the offering prices and determined the amounts to be reasonable; and

 

Whereas, The City Plan Commission and the Public Improvements Committee have determined that the properties have no possible municipal use and are surplus to the City of Milwaukee's needs and recommends sale of them to MMSD; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee that the properties at 635 North 40th Street and 428-42 North 42nd Street are declared surplus to municipal needs and that the proper City officials are authorized to execute quit claim deeds or other documents for the conveyance of the properties to MMSD; and, be it

 

Further Resolved, That the Commissioner of the Department of City Development ("Commissioner") is authorized to execute the temporary construction easement for the property at 4026-28 West Clybourn Street; and, be it

 

Further Resolved, That if any additional parcels designated for acquisition or for temporary easements for the project become City-owned through an In Rem action or other acquisition, the areas designated for acquisition may be declared surplus and conveyed to MMSD or temporary easements granted by the Commissioner without additional action by the Common Council; and, be it

 

Further Resolved, That upon closing the sale proceeds, less a 15 percent development fee to be paid to the Redevelopment Authority of the City of Milwaukee, shall be deposited in the City Tax Deficit Fund Account No. 334106, Fund 0001, Organization 9990.
