Resolution authorizing the Commissioner of Public Works and Comptroller to execute utility agreements with the Wisconsin Department of Transportation for work on city facilities in conjunction with the I-94 East West, Early East Leg (30th Street - 25th Street) contract work with a total estimated cost of $63,985, with an estimated grantor share of $57,586.50 and an estimated City share of $6,398.50.

Analysis

This resolution authorizes the Commissioner of Public Works and Comptroller to execute various Agreements for Payment for Relocation or Replacement of Municipal Utility Facilities Located on Public Held Land Required by Freeway Construction for various city facilities.

 

These agreements relate to utility work on city facilities necessitated by the construction of the I-94 East West, Early East Leg (30th Street - 25th Street), being undertaken by the Wisconsin Department of Transportation. This agreement provides for reimbursement from the Wisconsin Department of Transportation of 90 percent of City costs for all work on city facilities necessitated by the freeway reconstruction project in accord with Wisconsin State Statute 84.295(4m).

 

This resolution also authorizes the Commissioner of Public Works to prepare and/or review plans and estimates for the I-94 East West, Early East Leg utility work as necessary to accomplish the project. This resolution also authorizes the Comptroller to establish accounts as necessary to track the work and to submit invoices to the Wisconsin Department of Transportation for work completed on this project as approved by the Commissioner of Public Works, for a total amount of $63,985, with an estimated grantor share of $57,586.50 and an estimated City share of $6,398.50.

Body

Whereas, The State of Wisconsin Department of Transportation has scheduled the reconstruction of I-94 East West, Early East Leg (30th Street - 25th Street) in the City of Milwaukee, Milwaukee County; and

 

Whereas, Additional work being completed during the Early East Leg of the I-94 East West Reconstruction Project will require alteration of city facilities in Saint Paul Avenue, 30th Street, 29th Street, 28th Street, 27th Street, 26th Street, and 25th Street; and

 

Whereas, Wisconsin State Statute 84.295(4m) indicates that the Wisconsin Department of Transportation will pay 90 percent of the cost of alteration, rehabilitation and relocation of municipal utilities with the responsible jurisdiction liable for the remaining 10 percent of the cost; and

 

Whereas, The estimated costs for design and inspection of city facility alterations for the Department of Public Works will be $63,985, with an estimated grantor share of $57,586.50 and an estimated City share of $6,398.50 for City Underground Conduit, Communications, Sewer, and Water facilities related to the I-94 East West, Early East Leg contract work, State Project ID 1060-27-18/74; and

 

Whereas, In order for the City of Milwaukee to be reimbursed for the 90 percent share of the utility alteration cost on the I-94 East West, Early East Leg, the Wisconsin Department of Transportation is required to enter into Municipal Utility Agreements (UA) Numbers 622, 623, 624 and 625, in accord with relocation assistance policy; and

 

Whereas, The Wisconsin Department of Transportation has provided the City of Milwaukee with the necessary municipal utility agreements to facilitate reimbursement of City costs in the alteration of city facilities; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works and Comptroller are hereby authorized to execute the Utility Agreements (UA 622, 623, 624, 625), attached to this resolution by reference as though set forth in full; and, be it

 

Further Resolved, That the Commissioner of Public Works is hereby authorized to review or prepare plans as necessary to accomplish the required underground conduit alterations associated with the I-94 East West, Early East Leg work, provide construction inspection services, and to allow the Wisconsin Department of Transportation to include any necessary work in the I-94 East West, Early East Leg Reconstruction contract for City Underground Conduit, Communication, Sewer, and Water work associated with the I-94 East West, Early East Leg project, or have the necessary city facility work associated with the I-94 East West, Early East Leg project accomplished by City forces, whichever is deemed to be in the best interest of the City of Milwaukee and the I-94 East West, Early East Leg project; and, be it

 

Further Resolved, That the City Comptroller is hereby authorized and directed to create within the Capital Improvements Fund, Grant and Aid Projects, the necessary project grant chartfield values for engineering and construction inspection for the project expenditure and transfer to any of these accounts the amounts required under the grant agreement and City accounting policy but not to exceed a 10 percent increase of the total amounts reserved for the grantors share and local share of $5,000, whichever is greater, as follows:
