Title
Substitute resolution authorizing fee title and temporary limited easements with the Wisconsin Department of Transportation for the properties at 2237 North 7th Street and 3463 North 8th Street, to assist in the improvements for the Interstate Highway-43 Project, in the 6th Aldermanic District.
Analysis
This proposed substitute resolution permits the Redevelopment Authority of the City of Milwaukee to execute easements to facilitate Interstate Highway-43 Project improvements.
Body
Whereas, The Wisconsin Department of Transportation (“WisDOT”) presented the Redevelopment Authority of the City of Milwaukee (“RACM”) with an offer to acquire Fee Tile (“FT”) and a temporary limited easement (”TLE”) at the Redevelopment Authority of the City of Milwaukee (“RACM”) owned properties at 2237 North 7th Street and 3463 North 8th Street; and
Whereas, The requested Fee Title are; a FT of 45 square feet, more or less, that runs with the land for 2237 North 7th Street for a new ADA-compliant sidewalk; a TLE of 479 square feet, more or less, for 2237 North 7th Street; and a TLE of 168 square feet, more or less, for 3463 North 8th Street. Both TLEs will terminate upon the completion of the project or on the day the highway is open to the traveling public, whichever is later; and
Whereas, The appraisals presented by WisDOT have been reviewed by City Real Estate staff and the offering values have been determined to be reasonable consideration for the easements; and
Whereas, Pursuant to Wisconsin Statutes and as a condition precedent to the sale, lease or transfer of Land, RACM submits a copy of The Wisconsin Department of Transportation (‘WisDOT”) Project R/W Project Number 1228-22-23 report which is attached to this Common Council File, describing the terms and conditions of the proposed easement request; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Executive Director of the Redevelopment Authority of the City of Milwaukee, or designee, is authorized to execute said easements with WISDOT; and, be it
Further Resolved, That the proceeds from the easements will be retained by the Redevelopment Authority of the City of Milwaukee.
