This resolution authorizes private settlement of the discrimination/worker's compensation claim entitled Matyasz v. City of Milwaukee, et al., EEOC Charge No. 260970224; ERD Case No. 199604868, and Worker's Compensation Claim No. 95025893, in the amount of $13,009.09 which represents back wages.
 
 
BODY:
Whereas, James M. Matyasz filed a complaint of discrimination with the Department of Workforce Development-Equal Rights Division ("ERD"), ERD Case No. 199604868; the United States Equal Employment Opportunity Commission ("EEOC"), EEOC Charge No. 260970224; and Worker's Compensation Claim No. 95025893, alleging he was not returned to work to the City of Milwaukee Department of Public Works, Sanitation Division on or around July 8, 1996 because of a perceived handicap; and
 
Whereas, Mr. Matyasz has agreed to enter into a private settlement agreement to finally and completely resolve any and all past and future claims which Mr. Matyasz has or may have against the City of Milwaukee Department of Public Works, Sanitation Division in the amount of $13,009.09, which represents back wages; and
 
Whereas, Mr. James M. Matyasz will be granted full seniority as if he had worked during the period of July 8, 1996 through December 22, 1996; and
 
Whereas, The City Attorney recommends and the Common Council of the City of Milwaukee deems it expeditious and just to enter into a private settlement; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee that the proper city officers be and hereby are authorized and directed to issue a City of Milwaukee check in the amount of $13,009.09 to Mr. James M. Matyasz, such sum to be charged to the City of Milwaukee Department of Public Works, Sanitation Division, Wage and Salaries Account, Account No. 015656000; and, be it
 
Further Resolved, That the above payment to Mr. James M. Matyasz will be subject to both state and federal tax withholding and any other applicable withholding, in the year in which the payment is made, and the city will include such payment in James Matyasz' W-2. This represents a full and final settlement of these complaints upon receipt of a release of claim approved as to form and execution by the City Attorney.
