Minutes note: Ald. Bohl submitted a substitute 2 and noted that the proposed sub differs in that it adds a "Further Resolved" clause authorizing and direction the DPW to amend the Out-of-Program Agreement between the developer of Oak Hill subdivision and the City such that all references to sidewalks are eliminated and the curb-to-curb width of streets increased from 26 feet to 28 feet.

Title

Substitute resolution approving an exception to the requirement that sidewalks be installed in conjunction with the construction of all new streets.

Analysis

Section 113-12.5 of the Code of Ordinances requires that sidewalks be installed on both sides of any new street constructed in the city.  This requirement may be waived or deferred by the Common Council.  This resolution waives the sidewalk-installation requirement for all streets constructed in Oak Hill, a 34-lot single-family residential subdivision proposed for a site located generally south of West Greenwood Terrace extended and west of North Granville Road.

Body

Whereas, General Capital Group, a developer, has proposed development of a 34-lot single-family residential subdivision in the area generally located south of West Greenwood Terrace extended and west of North Granville Road; and

 

Whereas, This subdivision, to be known as Oak Hill, would include the construction of several new public streets; and

 

Whereas, Section 113-12.5 of the Milwaukee Code of Ordinances requires that sidewalks be installed on any new street constructed in the city; and

 

Whereas, This section also provides that the Common Council may waive the sidewalk requirement on a case-by-case basis; and

 

Whereas, Installation of sidewalks in the proposed subdivision would be inconsistent with the character of adjacent residential neighborhoods, none of which have sidewalks; and

 

Whereas, At two public meetings sponsored by the local alderman, neighborhood residents expressed unanimous opposition to the installation of sidewalks in the proposed development; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the sidewalk-installation requirement of s. 113-12.5 of the Code of Ordinances is waived with respect to the construction of all streets in the proposed Oak Hill subdivision; and, be it

 

Further Resolved, That the Department of Public Works is authorized and directed to amend the Out-of-Program Agreement between General Capital Group and the City of Milwaukee for the construction of public improvements in the proposed subdivision by eliminating all references to sidewalks and by increasing the curb-to-curb width of streets from 26 feet to 28 feet.
