Analysis
This ordinance makes various corrections, clarifications and minor substantive changes to the zoning code, including:
1. On-street parking spaces that are counted towards meeting off-street parking requirements must be available for public use during the hours of operation of the use (e.g., business) they serve, rather than 24 hours per day, as currently required.
2. Perimeter landscaping and edge treatment requirements are established for vehicle operating areas parallel to street lot lines on premises occupied by filling stations, automatic teller machines, drive-through facilities, car washes, etc.
3. A minimum-lot-area-per-resident requirement is created for transitional living facilities.
4. A roof overhang on a detached garage may project into a required setback area up to one-third of the required setback. Currently, no projection into the setback area is allowed.
5. There shall be no minimum front setback for a non-residential principal structure located on a corner lot in a commercial zoning district.
6. Glass in windows and doors that is to be used to meet glazing (façade transparency) requirements shall not obscure clear vision of objects on the other side of the glass. Spandrel glass shall not be counted towards meeting glazing requirements, either. Presently, glass that is to be counted towards meeting a glazing requirement must only meet a 65% light-transmission standard.
7. The regulations for signs in a lakefront overlay zone are revised to closely mirror those for signs in downtown zoning districts.
Body
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
Part 1. Section 295-201-676.3 of the code is created to read:
676.3. VEHICLE OPERATING AREA means an area adjacent to a street lot line where motor vehicles are operated, including but not limited to such areas located on the premises of filling stations, automatic teller machines, drive-through facilities and car washes.
Part 2. Section 295-205-17-d of the code is created to read:
295-205. Rules of Measurement.
17. MEASURING DISTANCES.
d. Distance Between Uses. Whenever the provisions of this chapter require measuring the distance between existing and proposed uses, the distance shall be measured as the shortest distance between lot lines of the 2 uses.
Part 3. Section 295-311-2-h-0 and 2 of the code is amended to read:
295-311. Appeals.
2. SPECIAL USE PERMITS.
h. Additional [[Finding]] >>Findings<< for Day Care Centers. No special use permit for a day care center, other than an adult day care center, shall be granted by the board unless the board finds, in addition to the findings required by par. d, that:
h-2. If the day care center is not located in a building containing an elementary or secondary school, religious assembly, community center, cultural institution or library as a principal use, the facility will not be located within 300 feet of a premises for which the common council has granted any of the alcohol beverage licenses identified in s. 90-4-1, 2 and 5 and such license is currently valid. This finding shall not be required for a day care center [[for which the board has granted a special use permit prior to February 3, 2007]] >>that is in operation as a nonconforming use or that has been granted a special use permit by the board<< .
Part 4. Section 295-403-2-b-2 of the code is amended to read:
295-403. Parking.
2. NUMBER OF SPACES.
b. Adjustment to Number Required.
b-2. One space for each on-street parking space that is located immediately adjacent to the site of the use, provided that such on-street space is available for public use [[24 hours per day]] >>during the hours of operation of the use<< . To qualify for this credit, an on-street parking space shall be in compliance with all city parking regulations and shall measure at least 20 feet long if a parallel space.

Part 7. Section 295-415-4-b-1 of the code is amended to read:

4. NONCONFORMING STRUCTURES.
b. Enlargements, Alterations or Relocation.
b-1. A nonconforming structure occupied by only conforming uses may be enlarged or structurally altered provided that the enlargement or structural alteration does not >>exceed 50% of the existing gross floor area and does not<< increase the existing dimensional nonconformity or the structure or create additional nonconformities.
Part 8. Section 295-503-2-j-1 of the code is amended to read:
295-503. Uses.
2. LIMITED USE STANDARDS.
j. Specialty or Personal Instruction School, General Office, Government Office, Bank or Other Financial Institution, General Retail Establishment, Artist Studio, Medical Office, Personal Service, Business Service, Catering Service, Funeral Home, Laundromat, Dry Cleaning Establishment, Sit-down Restaurant or Fast-food/Carry-out Restaurant.
j-1. In the RS6, RT4 and RM3 to RM7 districts, the structure to be occupied was constructed prior to October 1, 2002, was originally designed and intended to be occupied in whole or in part by a non-residential use, and has been [[continuously]] occupied by such non-residential use >>within the past 12 months<< . If the structure meets the first 2 of these standards, but not the third, the use shall be classified as a special use. If the structure does not meet either the first or second of these standards, the use shall be classified as a prohibited use. Any enlargement of the structure or area devoted to the non-residential use shall require special use approval by the board.

2. LIMITED USE STANDARDS.
f. General Office or Government Office. The structure to be occupied was constructed prior to October 1, 2002, was originally designed and intended to be occupied in whole or in part by a non-industrial use and has been [[continuously]] occupied by such non-industrial use >>within the past 12 months<< .
Part 26. Section 295-803-2-j of the code is amended to read:
j. Light Motor Vehicle Sales Facility or Heavy Motor Vehicle Sales Facility. The facility was in operation on October 1, 2002 >>and has been in operation within the past 12 months<< .
Part 27. Section 295-803-2-L-4 of the code is amended to read:
L. Light Motor Vehicle Repair Facility or Light Motor Vehicle Body Shop.
L-4. In the IO1 and IO2 districts, the repair facility or body shop was in operation on October 1, 2002, and has been in [[continuous]] operation [[since that date]] >>within the past 12 months<< . If this standard is not met, the use shall be a prohibited use.
Part 28. Section 295-803-2-m of the code is amended to read:
m. Light Motor Vehicle Outdoor Storage. The facility was in operation on October 1, 2002, and has been in [[continuous]] operation [[since that date]] >>within the past 12 months<< . If this standard is not met, the use shall be a prohibited use.
Part 29. Section 295-803-2-o of the code is amended to read:
o. Heavy Motor Vehicle Outdoor Storage. The facility was in operation on October 1, 2002, and has been in [[continuous]] operation [[since that date]] >>within the past 12 months<< . If this standard is not met, the use shall be a prohibited use.
Part 30. Section 295-805-4-i-2-0, a and b of the code is amended to read:
295-805. Industrial Design Standards.
4. SITE STANDARDS.
i. Fences.
i-2. Fences Along Streets. Fences along streets shall not exceed a height of [[4]] >>6<< feet, with the following exceptions:
i-2-a. A fence may be erected to a height of [[6]] >>9<< feet if it is set back at least 5 feet from the street property line and provided with trees and shrubs in accordance with the type “A” landscaping requirement of s. 295-405.
i-2-b. An ornamental metal fence or a combination ornamental metal fence and masonry wall may be constructed on the street property line provided the wall is no higher than [[4]] >>6<< feet, the combined height of the wall and fence does not exceed [[6]] >>9<< feet and the portion of the fence structure above [[4]] >>6<< feet is at least 50% open. An ornamental metal fence or a combination ornamental metal fence and masonry wall may be constructed to a height not exceeding [[8]] >>9<< feet if its is set back at least 5 feet from the street property line and provided with trees and shrubs in accordance with the type “A” landscaping requirement of s. 295-405.
