Analysis

This resolution authorizes the Commissioner of Public Works to reduce the public way occupancy fees chargeable to the developer of a planned housing complex to be located in the block bound by North Jefferson, East Chicago, North Jackson and East Menomonee Streets.  The proposed development meets criteria established by Common Council File No. 010357 and is thus eligible for a 90% fee reduction upon approval by the Common Council.

Body

Whereas, The Milwaukee Common Council has adopted File No. 010357 being an amendment to the City ordinance establishing fees for the occupancy of public rights-of-way during construction projects; and

Whereas, File No. 010357 stipulates that the Commissioner of Public Works may reduce public way occupancy fees by 50% when certain conditions are met; and

Whereas, Such fees may be reduced up to 90% when certain conditions are met and upon approval of the Common Council; and

Whereas, New Land Enterprises, a developer, intends to construct a housing complex on the block bound by North Jefferson, East Chicago, North Jackson and East Menomonee Streets; and

Whereas, This development meets the criteria established in File No. 010357 including being designed in a way that is consistent with the character of the surrounding neighborhood and having soil conditions that preclude on-site construction staging; and

Whereas, Occupancy of the public right-of-ways adjacent to the site as indicated on the developer's construction plans will not have a significant adverse impact upon traffic and parking conditions in the area; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee that the Commissioner of Public Works is hereby authorized to reduce the public way occupancy fee by 90% below the fee which would otherwise be charged for New Land Enterprise's development of the block identified above.
