Title

Analysis

This  resolution approves the plat of right-of-way required for the improvement of South 35^th Street from West Mitchell Street to West Greenfield Avenue.  It also authorizes the City of Milwaukee to acquire lands or interests in lands as shown on the plat of right-of-way for the project.

Body

Whereas, A project agreement has been executed by the Wisconsin Department of Transportation and the City of Milwaukee for the reconstruction of South 35^th Street from West Burnham Street to West Greenfield Avenue using Federal and State Aid under the Surface Transportation Program, in accordance with the Common Council Resolution File Number 100021, adopted May 25, 2010; and

Whereas, The project agreement between the Wisconsin Department of Transportation and the City of Milwaukee was revised for additional funding with the Common Council File Number 121746, adopted April 30, 2013; and

Whereas, The South 35^th Street improvement project requires land acquisitions from parcels that lie adjacent to the project right-of-way within the City of Milwaukee; and

Whereas, The Common Council of the City of Milwaukee authorized funds for consultant design services for right-of-way plat preparation, appraisal, legal description, and real estate acquisitions with the Resolution File Number 111700 adopted May 22, 2012; and

Whereas, The Common Council of the City of Milwaukee authorized the Commissioner of Public Works to execute documents required for the right-of-way acquisition associated with the improvement of South 35^th Street project with the Resolution File Number 130200 adopted July 2, 2013; and

Whereas, The City has acquired the consulting firm CH2M Hill, Inc. to undertake right-of-way plat preparation, appraisal, legal description, and real estate acquisition services; and

Whereas, It is necessary that the Common Council approve the plat of right-of way required for the aforementioned project and authorize City's consultant to acquire land or interests in lands shown on the right-of-way plat; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the right-of-way plat for project South 35^th Street from West Mitchell Street to West Greenfield Avenue be approved, and, be it

Further Resolved, That the City's consultant is hereby authorized to acquire lands or interests in lands as shown on the approved plat of right-of-way for South 35^th Street project; and, be it

Further Resolved, That minor revisions in the above plat to meet altered and unforeseen conditions encountered during acquisition of right-of way are hereby authorized and approved.
