Resolution granting permission to allow the owners of properties located along the south side of West Burnham Street and along the west side of South 37th Street to connect to the City of Milwaukee sanitary and storm sewer facilities for the planned Kubenik Industrial Park Development which is located at the southwest corner of South 37th Street and West Burnham Street under certain conditions enumerated herein.

 

 

BODY:

Whereas, On July 20, 1998, the Village of West Milwaukee adopted Resolution Number 16-R-98 requesting permission for connection of properties located along the south side of West Burnham Street from South 37th Street to 1450 feet west of South 37th Street, and along the west side of South 37th Street from West Burnham Street to 1000 feet south of West Burnham Street to the City of Milwaukee sanitary sewer and storm sewer facilities for the planned Kubenik Industrial Park development which is located at the southwest corner of South 37th Street and West Burnham Street; and

 

Whereas, The City of Milwaukee has sanitary and storm sewer facilities in West Burnham Street and South 37th Street capable of connections from these properties; and

 

Whereas, The adequacy of the sanitary and storm sewer facilities in West Burnham Street and South 37th Street has been reviewed and approved by the City of Milwaukee; and

 

Whereas, The Village of West Milwaukee will submit a final stormwater management plan for the proposed Kubenik Industrial Park; and

 

Whereas, Said properties may be subject to City of Milwaukee assessments depending on site development; and

 

Whereas, Future development in the subject Industrial Park will require additional connections to the City of Milwaukee sanitary system; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee that permission is hereby granted to allow; 1) the connection of a six (6) inch sanitary lateral from each of the properties located at 3909 West Burnham Street and 2001 South 37th Street; 2) a ten (10) inch sanitary sewer connection in West Burnham Street at 900 feet ± west of the center line of South 37th Street; and 3) a storm sewer connection in South 37th Street approximately at West Rogers Avenue, the size to be determined by the final stormwater management plan, to the City of Milwaukee sanitary and storm sewers for the planned Kubenik Industrial Park development which is located at the southwest corner of South 37th Street and West Burnham Street under the following conditions:

 

1. That all work shall be done at no cost or expense to the City of Milwaukee.

 

2. That in addition to the regular and customary sewer connection permit fee, a charge equal to an assessment shall also be paid to the City of Milwaukee for those properties subject to the City of Milwaukee assessment charge. Said charge shall be the rate per foot for sanitary and storm sewer in effect at the time of application multiplied by the frontage distances for the properties applying for connection permits.

 

3. That the Village of West Milwaukee shall require its contractor to obtain a permit for excavating in a public right-of-way and other applicable permits from the Commissioner of Public Works of the City of Milwaukee before commencing work within the limits of the City of Milwaukee.

 

4. That all work done in connection with building sanitary and storm sewers must be done in conformance with the rules and regulations of the Milwaukee Sewerage Commission, City of Milwaukee Plumbing Code and State of Wisconsin Plumbing Code.

 

5. That written notice shall be given by the plumbing contractor to the City of Milwaukee Sewer Maintenance Field Section three (3) days prior to making connections to the City of Milwaukee sewers.

 

6. That the Village of West Milwaukee shall be responsible for the maintenance of their sanitary and storm sewers and their connections to City of Milwaukee facilities in the City of Milwaukee right-of-way.
