Title

Substitute resolution approving the Memorandum of Understanding between the City of Milwaukee negotiating team and Milwaukee District Council 48, AFSCME, AFL-CIO (Local 1238) implementing a grievance arbitration award. 

 

ANALYSIS

This substitute resolution approves the settlement terms between the City of Milwaukee and Milwaukee District Council #48, AFSCME, AFL-CIO, implementing the parties’ interpretation of the grievance arbitration award.  This arbitration involved employees in the Engineering Technician I or II classification assigned to perform Road Life work. 

 

BODY

Whereas, The arbitration award was issued on August 29, 2007, in the matter of a grievance appeal filed by Milwaukee District Council #48, AFSCME, AFL-CIO, relative to compensation for certain employees in Engineering Technician I or II classifications in the Department of Public Works; and

 

Whereas, The arbitration award provided that the employees performing Road Life Work should be compensated at a rate of pay other than the Engineering Technician II rate of pay; and

 

Whereas, The City Negotiating Team and Milwaukee District Council #48, AFSCME, AFL-CIO, executed a Memorandum of Understanding embodying their interpretation of the arbitration award; and

 

Whereas, This Memorandum of Understanding constitutes the full and complete settlement of all issues between the parties in the matter of arbitration award and the 2006 grievance filed by Milwaukee District Council #48, AFSCME, AFL-CIO and copies of this memorandum are attached to this file and incorporated herein as though fully set forth at length; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Memorandum of Understanding between the City Negotiating Team and Milwaukee District Council #48, AFSCME, AFL-CIO, relative to implementing the August 29, 2007, arbitration award be approved; and, be it

 

Further Resolved, That the proper City Officials are authorized and directed to take the necessary action to implement the terms of this memorandum of understanding; and, be it

 

Further Resolved, That such sums as are necessary for the implementation of the aforementioned memorandum of understanding in accordance with its terms and conditions be obtained for and charged to the appropriate departmental budget accounts in accordance with the customary reporting and accounting requirements.
