Title

Resolution granting the Merrill Park Neighborhood Association permission to construct and maintain a gazebo in its neighborhood within a permanent limited easement for public enhancement at 3200 West Canal Street, in the 8th Aldermanic District.

Analysis

This resolution permits Merrill Park Neighborhood Association to construct and maintain a gazebo in the Merrill Park Neighborhood within a permanent limited easement for public enhancement at 3200 West Canal Street subject to review and approval of the Commissioner of Public Works.

Body

Whereas, Merrill Park Neighborhood Association is a non-profit association of residents of the Merrill Park Neighborhood, working to improve their neighborhood; and

 

Whereas, Merrill Park Neighborhood Association desires to construct a gazebo within a permanent limited easement for public enhancement adjacent to West Canal Street; and

 

Whereas, The City of Milwaukee acquired the subject permanent limited easement for the purpose of public enhancement; and

 

Whereas, The Common Council of the City of Milwaukee must pass a permissary resolution to allow Merrill Park Neighborhood Association to construct and maintain the gazebo within said permanent limited easement; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that Merrill Park Neighborhood Association is granted permission to construct and maintain a gazebo in a permanent limited easement for public enhancement at 3200 West Canal Street; ;and, be it

 

Further Resolved, That the method of construction of the gazebo shall be subject to the approval of the Commissioner of Public Works; and, be it

 

Further Resolved, That Merrill Park Neighborhood Association shall obtain all necessary permits for the gazebo; and, be it

 

Further Resolved, That Merrill Park Neighborhood Association shall keep and maintain the gazebo to the satisfaction of the Commissioner of Public Works; and, be it

 

Further Resolved, That whenever permission for the gazebo is discontinued for any reason whatsoever, including public necessity whenever so ordered by resolution adopted by the Common Council, Merrill Park Neighborhood Association shall not only remove the gazebo, but shall also restore to its former condition and to the approval of the Commissioner of Public Works the curb, pavement or other public improvement which was removed, changed or disturbed by reason of the granting permission for said gazebo. Such grantee shall be entitled to no damages due to the alteration and/or removal for such purposes.
