-Analysis-

 

This resolution authorizes the Commissioner of Public Works to issue a permit to occupy the public right-of-way in North 21st Street, north of West Cherry Street in excess of that allowable under Section 115-10 of the Milwaukee Code of Ordinances.

BODY:

Whereas, A request has been received to formally vacate the cul- de-sac in North 21st Street, north of West Cherry Street; and

 

Whereas, The petitioner for the vacation is desirous of occupying a portion of the North 21st Street right-of-way prior to the finalization of the vacation process; and

 

Whereas, Section 115-10 of the Milwaukee Code of Ordinances specifies occupancy shall not extend into the roadway of a public way more than one- third the width of the roadway, and, in no case, more than 20 feet; and

 

Whereas, The petitioner of the vacation of North 21st Street has requested to occupy the entire roadway right-of-way of North 21st Street, which is in excess of that allowable by Code; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is hereby authorized and directed to issue a permit to American Apartment Management Company to occupy the entire roadway right-of-way of North 21st Street for the installation of a fence and gate approximately 150 feet north of West Cherry Street; and, be it

 

Further Resolved, That all modifications to City facilities necessitated by allowing this occupancy of the public right-of-way in advance of the proposed vacation proceedings shall be made at no cost to the City; and, be it

 

Further Resolved, That the fence and gate within the public street right-of-way of North 21st Street will be removed and the pavement and walk areas restored in accordance with the specifications and restrictions established by the Department of Public Works of the City of Milwaukee and at no cost to the City if the vacation is not approved.
