Analysis

This Resolution also authorizes the Commissioner of Public Works to execute an Agreement with the WisDOT for the inspection of the Kilbourn Avenue Tunnels, and 9th Street Tunnel.

This resolution also directs the City Comptroller to authorize Capital Improvement funds over the next three years for the performance of Façade inspections on the mentioned tunnels.

The estimated total cost of the inspections is $450,000 with an estimated City share of $301,500 and a WISDOT share of $148,500. 

Body

WHEREAS, there are three tunnels located within the municipal limits of the City, described below:

 

Kilbourn Avenue Tunnels, South and North - MacArthur Square, Structures T-40-0292 and T-40-0293 (formally B-40-0292 and B-40-0293), (hereinafter collectively referred to as the “Kilbourn Avenue Tunnels”)

 

  9th Street Tunnel - MacArthur Square, Structure T-40-0001, (hereinafter “9th Street Tunnel”)

 

WHEREAS, the Kilbourn Avenue Tunnels are owned and maintained as described in the Agreement between the State Highway Commission of Wisconsin, now WisDOT, and the City, dated April 6, 1967 (the “Original Agreement”), and attached here as Exhibit A; and

 

WHEREAS, the 9th Street Tunnel is located on public roads owned and presently maintained by the City; and

 

WHEREAS, pursuant to 23 USC § 144, the Federal government requires an inventory of all tunnels on public roads, on and off Federal-aid highways, be maintained; and

 

WHEREAS, the Federal Highway Administration (“FHWA”) has promulgated rules pursuant to 23 USC §144 known as the National Tunnel Inspections Standards (“NTIS”) in 23 CFR Part 650, Subpart E; and

 

Whereas, 23 CFR §650.507 requires inspection of all highway tunnels located within Wisconsin’s boundaries, except for tunnels that are owned by Federal agencies or tribal governments and report the condition of said tunnels to the Federal government; and

 

NOW, THEREFORE, the Parties hereby agree as follows:

1.                     In accordance with 23 USC § 144 and the NTIS, WisDOT will inspect the Kilbourn Avenue Tunnels and 9th Street Tunnel.

2.                     The initial inventory inspections of the Kilbourn Avenue Tunnels and 9th Street Tunnel completed on July 18 to July 23, 2021.  Subsequent routine inspection shall be conducted at 24-month intervals, in accordance with 23 CFR §650.511 and Federal standards, unless WisDOT determines that more frequent inspections are appropriate.

 

Resolved,

 

By the Common Council of the City of Milwaukee that the Commissioner of Public Works is hereby authorized to execute agreements for the inspections of the Kilbourn Avenue Tunnels and 9th Street Tunnel.
