Title

Resolution relative to the cost participation and installation of traffic control devices in conjunction with four American Reinvestment and Recovery Act paving projects in various Aldermanic Districts at a total estimated cost of $590,131.13, with an estimated grantor share of $472,104.91, and an estimated City share of $118,026.22.

Analysis

This resolution authorizes the Commissioner of Public Works and Comptroller to enter into a funding agreement with the Wisconsin Department of Transportation for installation of traffic control improvements in conjunction with four American Reinvestment and Recovery Act (ARRA) paving projects in various Aldermanic Districts at a total estimated cost of $590,131.13, with an estimated grantor share of $472,104.91, and an estimated City share of $118,026.22, and to install these improvements upon execution of the agreement.  This resolution also authorizes the Comptroller to establish and transfer funds to the appropriate accounts for the four projects.  The total estimated cost of the four projects is $7,836,916.31, with a grantor share of $6,269,065.05 and a City share of $1,567,851.26.

Body

Whereas, The Project Agreements for South 1st Street from East Lincoln Avenue to South Kinnickinnic Avenue and East/West Keefe Avenue from North 7th Street to North Humboldt Boulevard were approved by the Common Council under File Number 040400; and

 

Whereas, The Project Agreements for South 13th Street from West Cleveland Avenue to West Windlake Avenue and East/West North Avenue from North Dr. Martin Luther King Jr. Drive to North Booth Street were approved by the Common Council under File Number 081512; and

 

Whereas, South 1st Street, East/West Keefe Avenue, South 13th Street, and East/West North Avenue are being improved with funding under the American Recovery and Reinvestment Act (ARRA); and

 

Whereas, The Surface Transportation Program provides cost participation for traffic control improvements in conjunction with the paving of highways located on the Federal/State Aid Highway System; and

 

Whereas, The total estimated cost of the four projects is $590,131.13 for the alteration and upgrade of traffic control signals and the upgrade of traffic control signs; and

 

Whereas, Twenty percent of the participating costs, or $118,026.22, is not reimbursable and is included in the Division’s 2010 Capital Purpose Project/Grant Number ST320100000; and

 

Whereas, Eighty percent of the participating project cost, or $472,104.91, is reimbursable from the Wisconsin Department of Transportation (WISDOT), and should be earmarked for this project in the 2010 Capital Grant and Aids Projects Fund Project/Grant Number SP032100100; and

 

Whereas,  The State cannot proceed with any project cost overruns and/or changes in scope of more than 5% without prior Department of Public Works approval; and   

 

Whereas, The Department of Public Works shall notify the Common Council of the City of Milwaukee at the next scheduled meeting of any such project cost overruns and/or changes in scope approved by the Department of Public Works; and

 

Whereas, The Common Council of the City of Milwaukee recognizes that the City may be 100% liable for any such project cost overruns and/or changes in scope as approved by the Department of Public Works; and

 

Whereas, The Common Council of the City of Milwaukee recognizes that the City may be liable for any costs incurred by the State should the City decide to withdraw from the project; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works and the Comptroller are authorized to enter into a funding agreement and are directed to execute four contracts with WISDOT for the installation of traffic control facilities in conjunction with four ARRA paving projects with unit prices based on a predetermined estimate prepared under the Federal/State aided highway program, copies of which is attached to this resolution, and is incorporated into this resolution as though set forth in full; and, be it

 

Further Resolved, That upon approval of this contract, that the Commissioner of Public Works is directed to install and modify traffic control facilities in conjunction with the four ARRA paving projects; and, be it

 

Further Resolved, That upon approval of this contract, the City Comptroller is hereby authorized to create within the Capital Grant and Aid Projects Fund the appropriate Project/Grant Chartfield Value for these projects; and transfer to these accounts the amount required under the agreement and City accounting policy, but not to exceed a ten percent increase of the total amounts reserved for the grantor’s share and local share or $5,000, whichever is greater as follows:
