This resolution establishes a Business Improvement District ("BID"), pursuant to Wisconsin Statutes, for the Downtown business area in the 4th Aldermanic District. The proposed BID includes commercial properties generally bounded by East Walnut Street, North 4th Street, West Wells Street, North 10th Street, the Menomonee River, East Clybourn Avenue, the Lakefront and North Jefferson Street. This resolution adopts a first year Operating Plan and budget for the BID, creates a District Board, authorizes special assessments totaling $1,700,533 on taxable properties in the BID, and approves and authorizes execution of a Cooperation Agreement between the City and the District Board to authorize a contribution of $35,000 from the Riverfront and Other Downtown Planning and Improvement Fund to assist in the District's holiday lighting program.
BODY:
Whereas, The Downtown business area is a vital and integral part of the City of Milwaukee ("City"); and
 
Whereas, A Business Improvement District ("BID") as authorized by Section 66.608, Wisconsin Statutes, will provide the financing mechanism for the Downtown business area to sustain its competitiveness by ensuring a safe, clean environment conducive to business activity; and
 
Whereas, Several property owners in the proposed BID have submitted petitions requesting the City to establish a BID in the area; and
 
Whereas, An initial Operating Plan has been prepared which describes proposed activities within the District and which complies in all respects with applicable Wisconsin Statutes; and
 
Whereas, Said Operating Plan has been reviewed and adopted by the City Plan Commission following a public hearing; and
 
Whereas, To supplement services currently provided by the City to owners and occupants of the proposed BID, the District Board and the City must enter into a Cooperation Agreement; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee that Business Improvement District No. 21 (Downtown Management District) and the associated District Board are created; and, be it
 
Further Resolved, That the initial Operating Plan for BID No. 21 (Downtown Management District), a copy of which is attached to this Common Council File, is adopted; and, be it
 
Further Resolved, That the City Treasurer, City Comptroller, and other affected departments are authorized and directed to collect and disburse the BID No. 21 assessments in accordance with the Operating Plan; and, be it
 
Further Resolved, That the Cooperation Agreement between the District Board and the City is approved and that the proper City officials are authorized and directed to execute said Agreement, a copy of which is attached to this Common Council File; and, be it
 
Further Resolved, That the City Comptroller is authorized and directed to transfer $35,000 from the Riverfront and Other Downtown Planning and Improvement Fund Account No. 31-618-0001 to Subaccount No. 31-618-1700 for providing funds to the District Board as outlined in their initial operating plan and said Cooperation Agreement; and, be it
 
Further Resolved, That all City officials, departments, boards and commissions are authorized and directed to take all actions and provide such assistance needed to carry out the intent and purpose of this resolution and the adopted Operating Plan for BID No. 21.
