This substitute resolution authorizes and directs the Commissioner of Public Works to execute a State/Municipal Agreement with the Wisconsin Department of Transportation (WISDOT) for funding for local street improvements under the Local Roads Improvement Program. The Local Roads Improvement program provides for 50% reimbursement for eligible costs. In 2000-2001, the City will be entitled to receive reimbursement up to a maximum amount of $1,094,833. City construction funds for projects undertaken under the LRIP program will be established in future resolutions. This substitute resolution also will authorize the City Comptroller to transfer funds from the Street Improvement - State and/or Federal Aid Program Account as originally budgeted in the 2000 Capital Improvement Program to the Street Reconstruct or Resurface Program - Regular City Program Account for projects to be undertaken under the Local Roads Improvement Program (LRIP) in 2000. This transfer is necessary in order to increase the flexibility in billing the State for eligible costs of the LRIP program. This substitute resolution further specifies that only project contractual expenditures are to be billed toward the LRIP grant amount and that the City Comptroller will make a memorandum entry at the completion of the LRIP program projects to record the transactions in the Street Improvement - State and/or Federal Aid Program.

BODY:
Whereas, State Statute 86.31 establishes a Local Roads Improvement Program (LRIP) to provide up to 50% reimbursement by the State of eligible costs for local street improvements; and
 
Whereas, Section 86.31 provides entitlement for county trunk highway, town road and city and village street improvements; and
 
Whereas, In 2000-2001, under the LRIP Program the City of Milwaukee is entitled to receive reimbursement up to a maximum amount of $1,094,833 for local street improvements; and
 
Whereas, In accordance with TRANS 206, the administrative rule relating to the LRIP Program, a project application to the Wisconsin Department of Transportation (WISDOT) has been submitted to apply for the City's entitlement; and
 
Whereas, WISDOT has provided to us for execution a State/Municipal Agreement for reimbursement funding under the LRIP Program; and
 
Whereas, The local street improvement projects shown are potential projects which are anticipated for funding under the LRIP Program, however, the actual projects will be approved through future Common Council actions; and
 
Whereas, Funds for projects to be undertaken under the LRIP program were originally budgeted in the Street Improvement - State and/or Federal Aid Program Fund in the 2000 Capital Improvement Program (Fund 0333 and Fund 0330; and
 
Whereas, It is advantageous and necessary that these funds be transferred to the Street Reconstruct or Resurface Program - Regular City Program (Fund 0333 and Fund 0330); now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee that the Commissioner of Public Works is authorized and directed to execute an agreement with the WISDOT for funding for local street improvements under the LRIP Program, a copy of which is attached to Common Council Resolution File No. 000014, and is incorporated into this resolution by reference as though set forth in full; and, be it
 
Further Resolved, That minor changes to the Agreement that do not change the intent are hereby approved; and, be it
 
Further Resolved, That upon execution of the Agreement, the Commissioner of Public Works shall proceed to undertake local street improvements for funding under the LRIP Program; and, be it
 
Further Resolved, That upon completion of the LRIP Program projects, the Commissioner of Public Works shall submit the Request for Reimbursement to the WISDOT for these projects; and, be it
 
Further Resolved, That the City Comptroller is hereby authorized to transfer appropriations to Infrastructure Services Division Account No. 0333-ST211000000; Street Reconstruct or Resurface Program - Regular City Program from the accounts as follows for the LRIP Program;

Further Resolved, That only project contractual expenditures are to be billed toward the LRIP program grant amount; and, be it
 
Further Resolved, That the City Comptroller will make a memorandum entry at the completion of the LRIP program projects to record the transaction back to the Street Improvement - State and/or Federal Aid Program for grant audit purposes.
