Title
Substitute resolution relating to implementation of a provision of the 2006 Budget relating to development of recreational facilities in the vicinity of Bradley Technology and Trade High School.
Analysis
This resolution establishes the conditions and procedures for expenditure of $2 million in capital borrowing funds in the 2006 City Budget designated for site preparation related to development of recreational facilities for Bradley Technology and Trade High School. This project, which is a joint effort of the City, Milwaukee Public Schools and the Bradley Technology and Trade High School Commission, will include demolition of the former Milwaukee Trade and Technical High School and its replacement by new recreational facilities to serve the students of Bradley Tech. Site preparation, including building demolition, environmental assessments, asbestos abatement and grading and seeding, will be funded by the City and MPS, while the Bradley High School Commission will finance and provide the new recreational facilities.

Whereas, The construction of Bradley Technology and Trade High School (“Bradley Tech”) resulted in the loss of recreational space that had been available to students of the former Milwaukee Trade and Technical High School; and
Whereas, Milwaukee Public Schools (“MPS”) has identified significant transportation costs and logistical problems associated with the lack of adequate recreational facilities in the vicinity of Bradley Tech; and
Whereas, MPS, the City of Milwaukee and the Bradley Technology and Trade High School Commission have proposed a partnership to develop adequate recreational facilities to serve Bradley Tech; and
Whereas, This partnership envisions a project that would provide for demolition of the old Milwaukee Trade and Technical High School, replacement of that structure with new recreational facilities and ongoing maintenance of the new facilities; and
Whereas, The 2006 City Budget includes $2 million in capital borrowing for site preparation related to development of recreational facilities at Bradley Tech; and
Whereas, It is necessary to establish the conditions for expenditure of these funds; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the City of Milwaukee appropriates, pursuant to the 2006 City Budget, $2 million in general obligation debt to fund demolition of the former Milwaukee Trade and Technical High School and other site preparation work related to development of new recreational facilities at that location; and, be it
Further Resolved, That the City Comptroller shall release the appropriated funds to MPS for execution of this project, subject to MPS providing an additional $600,000 from its fiscal year 2006 construction fund for the project, for a total of $2.6 million in funding for 2006; and, be it
Further Resolved, That if the total cost of this project is less than $2.6 million, all surplus funds shall be returned to the City; and, be it
Further Resolved, That it shall be the responsibility of MPS to make up any funding shortfall should total project cost exceed $2.6 million; and, be it
Further Resolved, That City funds for this project shall be used only for demolition, environmental assessments, asbestos abatement and land preparation, including restoration of the site as a vacant lot that is graded and seeded from sidewalk to sidewalk; and, be it
Further Resolved, That MPS shall be responsible for maintenance of this property following completion of the City-funded activities; and, be it
Further Resolved, That the City Comptroller shall not release the funds appropriated for this project until the Lynde and Harry Bradley Technology and Trade High School Commission:
1. Enters into an agreement with the City to fund and implement improvements to the site in question consisting of recreational facilities for students of Bradley Tech.
2. Submits a design for the recreational facilities to MPS and the City’s Department of Administration for approval.
3. Submits to the Department of Administration a plan that demonstrates the availability of adequate funds from non-City and non-MPS sources to implement the design so that the project can be completed by September, 2007.
4. Agrees that MPS shall be the owner of the improved site following completion of this project.

Further Resolved, That the proper City officials are authorized and directed to enter into the intergovernmental and other cooperation agreements and contracts that are necessary to implement this project in accordance with the provisions of this resolution.
