Title
Substitute resolution to vacate excess right-of-way at the Southwest Corner of North Jefferson Street, East Pleasant Street and North Water Street within the Park East Redevelopment Plan Area, in the 3rd Aldermanic District.
Analysis
This substitute resolution vacates the above excess right-of-way in accordance with vacation proceedings under power granted to the City of Milwaukee by Section 62.73, Wisconsin Statutes, and Section 308-28, Milwaukee Code of Ordinances. This vacation was requested by the Redevelopment Authority of the City of Milwaukee to consolidate land within the Park East Redevelopment Plan Area for future development of Block 25 'B'.
Body
Whereas, It is proposed that the excess right-of-way at the Southwest Corner of North Jefferson Street, East Pleasant Street and North Water Street within the Park East Redevelopment Plan Area be vacated pursuant to the provisions of Section 62.73, Wisconsin Statutes; and
 
Whereas, The Department of Public Works has been authorized and directed to prepare a coordinated report estimating all costs and benefit assessments that will be incurred with said vacation; and
 
Whereas, Said vacation has been reviewed in accordance with Section 308-28, Milwaukee Code of Ordinances; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that said excess right-of-way as indicated by Exhibit A and bound and described by:
 
That part of excess street right-of-way in the Southwest 1/4 of Section 21, Township 7 North, Range 22 East, described as follows:
 
Commencing at the present Northeast Corner of Lot 3 in Block 121 of Fractional West 1/2 of the Southwest 1/4 of Section 21, a recorded subdivision, in said 1/4 Section; thence North 89 deg. 23 min. 11 sec. West, along the north line of Lot 3 aforesaid, 119.61 feet to the present Northwest Corner of Lot 3; thence North 00 deg. 29 min. 16 sec. East, along the northerly extension of the present west line of Lot 3 aforesaid, 29.64 feet to a point; thence North 44 deg. 33 min. 28 sec. East 97.47 feet to a point of curve; thence Northeasterly, 65.64 feet along the arc of said curve which has a radius of 654.66 feet with its center lying to the northwest having a central angle of 5 deg. 44 min. 41 sec. and whose chord bears North 41 deg. 41 min. 07.5 sec. East 65.61 feet to a point; thence South 89 deg. 15 min. 57 sec. East 19.32 feet to a point; thence South 30 deg. 57 min. 47 sec. East 10.20 feet to a point on a curve; thence Southwesterly, 48.63 feet along the arc of said curve which has a radius of 297.50 feet with its center lying to the southeast having a central angle of 9 deg. 21 min. 54 sec. and whose chord bears South 11 deg. 07 min. 26 sec. West 48.57 feet to a point of tangency; thence South 06 deg. 26 min. 29 sec. West 69.14 feet to a point; thence South 00 deg. 15 min. 41 sec. West 24.01 feet to the point of commencement, is vacated; and, be it
 
Further Resolved, That upon deposit of the funds required, the Commissioner of Public Works and/or the City Engineer are authorized to implement the actions listed in the coordinated report relating to said vacation; and, be it
 
Further Resolved, That as provided by Section 80.32(4), Wisconsin Statutes, said vacation shall not terminate the easements and rights incidental thereto acquired by or belonging to any county, town, village or city, or to any utility or person in any underground structures, improvements or services, as enumerated or otherwise existing in said description of land above described, both easements and rights and all rights of entrance, maintenance, construction and repair with reference thereto shall continue as if said excess right-of-way had not been vacated.
