Title

Resolution accepting a donation of bronze sculptures for Hartung Park.

Analysis

With this resolution, the City of Milwaukee accepts a donation of a set of bronze sculptures of prehistoric fossils from the Hartung Park Community Association for placement in Hartung Park.

Body

Whereas, On July 12, 2006, the Common Council adopted File Number 060292, a resolution designating the Hartung Quarry property, located south of West Keefe Avenue and east of North Menomonee River Parkway, as the site of a future park, to be known as “Hartung Park”; and

 

Whereas, On February 26, 2008, the Common Council adopted File Number 071402, a resolution authorizing the Department of Public Works to fund and construct Phase I of the Hartung Park project using a $250,000 State of Wisconsin Stewardship Local Assistance Grant and $250,000 in City capital funds; and

 

Whereas, Phase I of Hartung Park will include the following components:

 

1. Grading of 5 to 6 acres out of a total site area of approximately 16.5 acres.

 

2.  Construction of a playground, including paved pathways and a rubberized play area surface.

 

3.  Development of several rain gardens.

 

4.  Planting of tree clusters.

 

5.  Installation of fencing to separate Phase I from the remainder of the Hartung Park site, which, for the time being, will continue to be used by the Department of Public Works for the depositing of clean fill.

 

; and

 

Whereas, Construction of Phase I of Hartung Park is currently underway, with completion anticipated by the end of 2009; and

 

Whereas, The Hartung Park Community Association (“HPCA”), a grass-roots organization of nearby Milwaukee and Wauwatosa residents, has been instrumental in designing and planning for Hartung Park, and will play role in stewardship of the Park; and

 

Whereas, HPCA has commissioned a local artist to create a series of bronze sculptures of prehistoric fossils that can be placed in Hartung Park to depict the natural history of the area; and

 

Whereas, HPCA desires to donate these bronze sculptures to the City of Milwaukee; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the City of Milwaukee accepts a donation of a set of bronze sculptures from the Hartung Park Community Association for placement in Hartung Park; and, be it

 

Further Resolved, That the Commissioner of Public Works shall install and maintain these sculptures in Hartung Park; and, be it

 

Further Resolved, That, in light of the fact that these sculptures are now the property of the City of Milwaukee, the City of Milwaukee shall indemnify, defend, and hold harmless the Hartung Park Community Association, its respective directors, officers, employees, and any successor-in-interest from and against any liability, cost, loss, expense, damage, or injury to person or property that may at any time be attributable to the sculptures.
